    Well I finally recieved my 4th check from PBD today after it was sent to them on the 29 May. I counted back and today is working day number 46 (i might have got it yesterday if it hadnt been for the strike) so it looks like they are hanging on and posting it right at the last minute :mad:

    I also notice that the check and invoice are printed now, so can I assume that all future cheques will now be recieved in a timely manner since they don't have some poor person single handedly writing the cheques one by one, I very much doubt it!

    I was reading the dispatch note I got with my phone the other day and nearly fell of my chair in shock when I read that they would be sending my any cashback within 14 days of recieving it! My quickest cheque so far was the first one which took 6 weeks, every subsequent one has taken a couple of weeks longer than the last.

    They probably will, but then it is up to you to argue (quite rightly) that they had no right to vary the terms of your contract unilaterally and without telling you. 80% of people won't bother, they will just give up. It would probably have been less complicated if you claimed on the old form though, they may now argue that you have signed and agreed to the the new terms when you sent the claim form in. However I am pretty sure the Unfair Contract Terms Act would say that is unreasonable.

    If you look at my other posts in the coolnewmobile and phoneboxdirect merged threads and the voluntary code thread, you will see that I am trying to resolve the problem in advance of my first cashback claim by writing to my network provider and trying to invoke the new voluntary code of practice which OFCOM published on Tuesday. That code says anything less than 60 days to claim is unfair, and it is up to the phone company to police this, and apply sanctions to the reseller if they refuse to comply. As others have pointed out, this may not apply to me as my contract was taken out before the date the code was published. However I thought it was worth a try, for the sake of filling out an online form. Even if it does not apply to me, the operator (or, if applicable, their appointed distributor [maybe Dextra Solutions??]) is now required to exercise "due diligence" and monitor the retailer, and, according to the code:
    • Reserve the right to request copies of the retailers customers terms and verify that that are compliant with the operator’s minimum business terms (which will include reference to applicable laws)
    So now that I have drawn the current terms to their attention, I can hardly see how they can escape their responsibilities of due diligence, even if this only benefits customers who bought a phone after 31 July 2007. I will let you know what the outcome is.

    I Got My Fone On 30/ Mar /2007, Nokia N72 With 420 Cash Back

    Got To Send Off 4 , 6 , 8 ,10 , 12 Bills So I Sent First Page Of My (4th Bill Which Effectively Is My 5th Bill)) Bill Of Julys (after 120 Days Connection) Cash Back .

    A "mr S.taylor " Signed For It On 31/ Aug But I Havent Heard Since , Either On My Emails , Even Though I Have Added There Msl.co.uk Email Address To My Hotmail Safe List.

    does any one know if an s taylor works there or not ???

    I take it you mean your letter was signed for on 31st July? PBD have always taken at least a week in my experience to send an email to say they have recieved the claim from.

    I have always sent them the entire copy of my bill and not just the first page. Good luck with your claim anyway, PBD are up to some very nasty tricks at the moment.

    Oops! they have changed the goalposts. I just looked again. My form which I downloaded at the time from the above address says the time limit is 1 calendar month. This form says 21 days, even though it has the same reference at the top, zxzz31473692314x13. If anyone wants a copy of the previous form, PM me with your email address and I will send it.


    Received a letter from them yesterday morning saying that they moved address in May 06 and at that time informed all customer by way of sending them Claim Forms (I only ever received 1 claim for which arrived by e-mail when I took out the contract - I saved it to my Hard Drive and it definitely shows the old address). They also say that I should have known to send all claims to their Bingham address since all their letters and Cashback Payments come from the Bingham address and is displayed as such. This is fair enough but in my opinion is not enough to let me know that I should be sending Claims to any address other than that on my claim form.

    Also, I have a problem with them short paying me. They say I am on a tariff 420-456 (I think). I am not, I am on Talk and Text 1100 which clearly shows on all of my 12 bills. They say that 420-456 tariff is a 'shortened version' of the one I 'think' I am on but the amount payable by cashback is less !! Yeah right !!

    To sum it up, each time they have made a cashback payment they have paid me £13.50 short, because I am not really on the tariff that I think I am on !!

    Really sneaky company obviously hoping that they will wear people down so much that they will give up - probably a lot do and thats why they are able to carry on trading - I wont give up. I will pursue them until I get every penny they owe me - or they go bust - whichever happens first.

    ok tks its jus been over a wk so i hopefully shld get a confirmation letter soon .

    as well as if everyone has sent by recorded leter then cant ppl say what names signed the letters becase royal mail will tell u then it will help ppl on forums too .........???

    i would reassure me knowing that a s.taylor works there and signed for it
