    My 120 days were up on sunday the 29th ( connected 30th march), my lastest bill is dated 20th july? Is this not the right bill, i though it was the bill nearest to the 120 days? Will it not be too late to claim once i get the next bill in?

    Also just dug my wardrobe out found the oringinal delivery bag phone came in and theres a piece of A4 paper with a reference number on it, saying thankyou for choosing phone boxdirect and lists the items i recieved - is this the dispatch notice i recieved?

    Right document, wrong bill - I think - someone please correct me if I am wrong.

    But you know if I were in your shoes, I would go speak to Consumer Direct. Personally I would be much happier not sending the document, then they might refuse, them you would complain, then they might threaten you with litigation, then you sue, then they pay you off just before the hearing or you win and get the dosh. It sounds easier to me than going through this every time you claim, and I think they are more likely to be still operating in 4 months time than they are in 12 months time. What do others think?

    PS if you decide to take the long road and abide by the new terms that they have not even told you about, remember you only have 21 days from the bill date.

    I think there's a bit more to it than that with them now. Make sure you at least send it recorded delivery, take full copies of eveything you put in the envelope and get a witness to testify to what went in for starters. This has become a game with a stacked deck so you have to play accordingly.

    This is an interesting concept in contract law. A contract cannot exist if one party can unilaterally vary the terms. Offer, acceptance etc
  • O.K, if i have to send my claim in within 21 days of 120 days of connection, and the last bill i got was dated the 20th july, if it is the next bill i need which will be 20th of august then by the time i get this, it will be too late to claim

    No mobilejunkie, has to be Special Delivery, preferably with Consequential Loss Insurance for £1.35 extra (you have to ask over the counter for it). The rest I agree with, but Recorded Delivery is not accounted for en route, and it is quite common for them to get delivered without a signature. The T&Cs require "proof" of their signature, so without that you may as well just burn the money.

    actually special delivery without consequencial loss would be £4.30 per claim. Voctoria, I suggest you read through ALL the threads on this one and on Coolnewmobile (same company). All the information as to which bill you need to send is on there. You have 28 (previous t&c) days from the date of the bill to claim. It really IS very easy.

    Exactly, which is why I prefer to go my what my terms said when I bought the phone. Besides, they (who made the contract with) have not told me my terms have changed, so how can they have changed?
