    if you analyze what the guy said to you that they will pay for the new flight home if you are stuck there, then it stand to reason that you are stuck here first and they should do the same and get you out there and back on another airline. tell him that , what is the difference.
    i hope you get my drift. i think he just defeated himself with the example he gave you.

    call the ombudsman and let us know what is their opinion.

    I did just this about an hour ago. I made it clear what I was asking, and it is their opinion (the guy I spoke to didn't know, but checked with a colleague) that the extra cost for buying a more expensive replacement air ticket is considered to be one of the extra costs associated with the supplier not being able to fulfil the original contract, as outlined in the Act

    They said that if the bank refuses, file a complaint with the Ombudsman.

    You have to be firm, but polite, with them. To be honest, I don't think a lot of the co-called "Customer Service" agents have a clue, neither do their superiors, so you probably know more about what you are entitled to then they do. Of course their only recourse then is to delay and waffle ! Or, in my first call, because I knew more than they did I was called "arrogant" ! good Customer Service !
    The Law is simple and clear cut. In my case I paid Maxjet £1100 for my tickets. I then had to pay BA £1998 for replacements. £1100 was put "in dispute" then credited to my account; the difference was sent to me by Goldfish by cheque.

    I sent HSBC (Mastercard) a letter returning their form on 14th April and they have received it, when I called them up and spoke to a ladie she reckons my form won't get processed until 1st of May, all she kept saying was that this is how long it takes for HSBC to do their paper work and look into the case, fuming as I was I decided to speak to a supervisor instead, they reckon they are sending out ANOTHER form to sign and send it back to them... HSBC are USELESS.

    Don't think I didn't quote the Consumer Credit Act 1974 (CCA74) because as firm as I was... I was going no where. My only option with HSBC is to wait this out, sign their form agreeing all is true... and for them to get their act together.

    Do I play the waiting game or should I go straight to the Financial Ombudsman?

    hi,

    in whose opinion that said they are (supplier)liable. when you said i called them up an hour ago. i assume you meant the ombudsman?
    if that is the case and your cc people are uncooperative, ask them to write a final statement that they wont cover the extra cost

    then send it to you know who. i believe they will respond quite quickly and i think they are free.

    we are all here singing from the same hymn sheet while these cc people are still in the dark ages!!

    now that you have started the ball rolling you might as well wait.

    as i said all along they have procedures to follow and just like any claims they have to fully investigate that what we say are true because i paid my tickets last september and the bank would have assumed i would have travelled by now! but my trip is in july.

    so you must understand the bank's predicament. like any insurance claim it will take time -so long as they dont say you wont get your money back, wait. if they do say that, then you have no choice but to go to the ombudsman.

    the banks are just protecting their clients/our and shareholders money.
  • Hi, people...I just received a claim form from Barclaycard. It states that i need to send copies of support documentation to them for review.

    Could someone tell me if i've got the correct support documentations in accordance with the claim form, pls?:j As I dont hope the CC company use too many excuses to delay or decline my refund.:o

    Below is a list of support documentation that B-card want:

    1. copy of customer sales voucher (I don't have this one.)

    2. copy of holiday invoice/confirmation (I have an electronic copy of confirmation letter from Oasis)

    3. copy of air ticket (The e-ticket is included in the confirmation letter)

    4. Have you claimed else where for reimbursement? If yes, please state with whom, your claim number and the present position of your claim.
    :confused: I'm confused about this question, because B-card says 'if the liquidators are unable to help, and so that we can review your claim under Barclaycard Travel Policy'.

    I have only sent a claim form to OASIS and got an acknowledge letter. Is this sufficient to prove the liquidator unable to help? Or do i need to call/write/ email VISA and KPMG (the liquidator) to get something to prove to B-card?

    i am not with barclaycard. ihope this clarify things for you.

    questions 1 - 3 is covered by the booking confirmation and acknowledgement of your payment by oasis. so it acts as a sales voucher, payment receipt and e ticket all rolled into one email to you from oasis.

    the 4th question;- you must declare to BC of your claim v.v. oasis liquidators, KPMG. it does not impede your claim against BC.they will pay you first and want to see if you will get double paid by oasis after they paid you.
    so, they want you to acknowledge to them that if that is the case you will pass on any money KPMG gives you back to BC.

    They would know as they will also file a list of BC customers to KPMG too.there will be a lot of cross/ double claim filed with KPMG.it will be a nightmare there in hk.

    i think that's why they want you to fill another form. only my presumption.

    I called Lloyds TSB for the 4th time in 10 days and again asked for a Visa Debit Chargeback form.

    They said that a form had been sent on the 15th which I have not yet received and they will send the form again. It would be helpful (to us) if the form could be downloaded!

    I'm going to call them daily until a form appears on my doorstep and if nothing received by the end of this week I'll complain to the financial ombudsman.
