Oasis airline in liquidation- what to do?

    I had fully paid for my 2 tickets in Aug 2007 to fly next month, since the news about Oasis came out last week, I immediately reported to my credit card company, and I have received the full refund last Friday.

    Chase them up! don't let your credit card company off so easily.

    If you read through this thread you can claim back the value of the tickets and also any difference for the same flights to the same place on the same dates... (CC only)
  • I just read the Hong Kong local news (Apple Daily) saying that HSBC and Heng Seng Bank are arranging their credit card customers refund. I wonder if it applies to customers using HSBC UK credit card customers as well.
    I bought my ticket with my MBNA credit card, I am uncertain if I could get my money back as the people I spoke to is not very helpful. Do you think we will definitely get our money back? Should I keep chasing them every day? Can someone here managed to get your money back? If so, what credit card did you use when you purchase the ticket? I am a bit helpless here....

    Hi Moonrakerz - one question...Oasis Hong Kong is only in Provisional Liquidation...can we still claim the difference on the replacement tickets with the credit card company? Or they can ask us to wait for further developments?? Thanks.

    It is clear that we can claim from both oasis or the credit card company or both. we do not have to wait for oasis liquidators to decide. if they refused to pay, you can go to the county court(costly be refundable) or complain to the Financial Ombudsman -which would be cheaper.

    There is a breach of contract and also a break in the lender(credit card Company), borrower ( us the passengers ) and seller ( oasis ) chain.

    Both your credit card and oasis can be sued "jointly" or "severally" ie claim both at the same time ;- that is what the term means.

    if you read the ombudsman cases they judge on, ours is very straight forward.a guy claimed his deposit back from a car hire company!! under section 75. and the ombudsman told his credit card company to pay him back the deposit which they agreed.if not their fine would be high and the bank censured.

    dont get fobbed off by the credit card company.quote section 75 and if no luck tell them you are going to complain to the financial ombudsman.remember, the bank's staffs are not lawyers!!

    also claim compensation for booking on comparable flights with expensive cathay and ba. dont be dishearten guys. we are entitled to new, more costly flights under s.75 dont let them off because they will be in breach of contract not us under the law. banks hate to break the law more than customer satisfaction.

    the law will ensure that we are put back to our original legal position before oasis went bust i.e. back to our original flights.that's the law.

    be firm and dont worry!!

    greentea, yes your credit card company has to pay you under section 75 if not the financial ombudsman will tell them to refund your money back and compensate you for rebooking on a more costly flight!!

    get the statement on your credit card that show payment to oasis hk, plus oasis email to you cancelling your flight and then write a covering letter to your credit card company saying you are claiming a refund and extra cost for booking new tickets; then call them up and ask for their dispute team's address.

    sent all this off by "special delivery".

    at all time in your letter mention section 75 of the consumeer act 1974 to show them that you know what you are doing so that they cant fob you off.

    they are in breach of contract not us. we are protected under the CCA 1974.
    the credit card lawyers will tell the bank to pay up because they do not have any legal argument to decline our claims. i havent seen cases like ours going to court because the banks know it would be suicidal if they did and probaly those who chose to fight will get sack!! like the T5 mess.

    It appears that under equal liabilty the Credit card company is just as responsible to get you to your destination, as promised by oasis.

    so if you rebooked and had to pay more ,then you are entitled to be compensated for it -as long as you dont book first class.

    also if you are told to claim first from oasis,ask them to put this down in writing. tell them you will ask for compensation for wrongful advise. because you can also claim compensation for wrong and incorrect advise from your credit card company. example cases are shown from the link above.

    dont be bullied by the credit card companies. they have made enough profits off us over the years. i have claimed both refund and compensation from lloyds tsb and john lewis. will post their reply. also posted claim to oasis in hk which i am entitled to under joint/equal and several liabilty rights under contract law.

    if one is double paid, you have to pay your credit card back, if not you are breaking the law and they will know.
