Oasis airline in liquidation- what to do?

This is a good paper to keep up to date with news about Oasis. This was in today's Hong Kong 'Standard'
Grounded Oasis Hong Kong Airlines has received "a number" of expressions of interest from potential new investors, said KPMG, the provisional liquidator.
There are a "comfortable number of really serious players" that the provisional liquidator is talking with, said Edward Middleton, head of restructuring services at KPMG, putting the number at "a handful."
He said: "The financial situation is dire."
Interested parties include local investors and foreign companies, he said, declining to provide more details. KPMG has not received interest from Cheung Kong (Holdings) or any unlisted arm of Cheung Kong Group, Middleton said, adding Cheung Kong deputy chairman Victor Li Tzar-kuoi has not approached KPMG either.
Cheung Kong said yesterday it has not made any offer to buy Oasis and is not exploring the matter, refuting reports in Ming Pao Daily.
Middleton said no Oasis staff had yet been laid off. He said the company is responding to claims from ticketholders but "it's too early to say" whether they will get refunds.
Founder Raymond Lee Cho-min, with his wife Priscilla Lee Hwang at a first public appearance since Oasis was grounded, said he is "very optimistic" about its future. "It is our hope for Oasis Airlines to continue to survive."
Before the press briefing began, Middleton said questions about the reported quarrelling between Oasis investors "will not be answered."
The Standard revealed Monday that a fallout between the Oasis partners triggered the collapse of the carrier. "This is not a forum for that to be explored," Middleton said.
Questioned about his relationship with other Oasis investors, Lee said: "We are still really good friends. We will still remain good friends in the future."0 -
I have two questions:
(1) Will the credit card company say they will only refund me until after the travel date is passed, so that they can be certain Oasis cannot provide the services? After all, the airline is only in "provisional" liquidation.
(2) Let's say somebody takes over Oasis and the flights are resumed before the travel date, but I have already bought replacement tickets with another airline. In this case, I'll end up having two tickets and the credit card company will not pay up because Oasis has come back to life.
Any comments on the above are most appreciated.0 -

tell the cc the contract has been terminated by oasis, it no longer exist!. it doesnt matter if they come back .ask the financial ombudsman to judge on your case.they will instruct them to pay.
To me, the email cancelling the flights is also a termination of oasis contract by themselves with us irrespective of "provisional"liquidator.
Also in the letter it SAYS; "YOU WILL NEED TO MEET THE COST OF THESE ALTERNATE FLIGHT ARRANGEMENTS YOURSELVES", which we have done by rebooking on another airline.tell the cc company that!! oasis contract is null and void.
in a court of law we have every right to claim a refund "equally" from oasis and the credit cards under s.75 .
it doesnt matter if they come back from the dead, we cant wait for them.we have to make alternate plans now- as advised by them in their email letter.
To sum it up, there is no more contract between us and oasis. . a new oasis will be a different entity which we are not contracted to because the new owners will not want to be sued all the time - so they will operate under a new company just like railtrack. even though it has the same name but the holding company would be different.

Just been in touch with Halifax again, it seems despite the lady last week telling me that the legal dispute had been raised, it actually can't be done until after my departure date (June 1st) This is for my claim with a Visa Debit card by the way. Is this correct?
She asked me if I had contacted Oasis first, which I haven't but don't intend to as I can't see any joy coming through that channel.0 -

Section 75 only covers credit cards/ consumer credit. sorry cant help here. you have to dig out visa's terms and conditions governing debit cards.
carefully look under conditions in regards to "chargebacks" to the vendor's banks.

I don't personally have any legal knowledge about this situation, only what these fantastic guys on the site tell us.
However, ..... i would suggest that you do at least complete the claim form from the Oasis website. Get it filled in ASAP and EMAIL it (from what people say, the fax system does not seem to get through as easily). I emailed the form and got a standard acknowledgement - to whom it may concern, etc - a few days later via email.
At least then, when you have done that, it gives the bank or whoever less delaying tactics. And remember of course to keep copies of everything, especially notes on conversations with the bank including dates and names for the file you should be building. These people are not going to give in without a struggle it seems.0 -

You are wasting your time trying to claim from OASIS, you be be last in the queue behind the man who owns the aircraft, the one who supplies the fuel - even the one who cleans the toilets in the Oasis office block.
Use Sect 75 of the CCA and get what you are legally entitled to from the credit card company. Don't be messed around - tell them to pay up - or take them to Court.0 -
I completely agree with Moonrakerz and am under no illusions re claiming from Oasis which is obviously a no-hoper, certainly in the short term if not in the long term as well.
I just think that for very little effort, it stops the credit card company barking up that tree! It also shows that you have completely fulfilled your side of the bargain.0 -
I'm also waitin to hear from the debit (Visa) card ppl...gonna try them again tonight (need to wait fopr my frind to pass me over on the phone since it was his card) and push the chargeback scheme...0

I didn't bother with the claim form from Oasis coz I thought I'll just concentrate on the credit card company and give them no excuse to delay my claim with them....is this wise???
Or should I claim on both sides???0
