    I faxed the documents yesterday at 12.30 pm and got a phone call today at 11.00 am so I was pretty impressed especially as i live in Spain!

    Maybe it was as a result of a telephone call I made and various emails which possibly set up something of a rapport. Today though I used my new tactic which is to be persistent but nice - I usually get cross when people annoy me in this situation (I imagined that 'Sue' had 1.8 needy children and cycles to work in the rain everyday).

    Quoting the act in writing may also have had something to do with it.

    I am hoping of course that i don't have to be too nice when I am pushing for the additional costs of new tickets. As yes, clearly it is the law. Will let you know.

    Well done for getting your refund. i am still awaiting my reply from HSBC.
    So are you planning on getting them to pay the additional costs too? Though they have given you back the original amount...will it work?? I just wrote to claim for the original amount ...

    All thanks to Lucky88 and others for legal advice and general support in getting this money back.

    I am definitely claiming for additional costs as you will see from the letter - 'As a result, I have a clear claim for ‘all losses’ ie replacement tickets from Gatwick to Hong Kong, return.'

    Without the costs for the difference, I don't know if I can go to HK as the new flights are so much more. I guess that applies to a lot of people.

    At the request from Visa for a detailed breakdown of these likely costs, this is what I sent by email today which was acknowledged by them:

    Under section 75, I would like to claim the difference between the cost of my original flights to and from Gatwick / Hong Kong with new flights/transport.

    The original flights were £712.00 return. This was to depart Gatwick xxx May, to arrive back at Gatwick xxx June.

    I cannot give an exact price of replacement flights as they appear to fluctuate on a daily basis. However, I can state what they are at this moment of today’s date. All prices include taxes, fees, charges and surcharges.

    With www.virgin-atlantic.com Heathrow to Hong Kong return is £948.00

    With www.ba.com the same economy tickets are £988.80

    With www.cathaypacific.com the same tickets are £3012.06 (!)

    I must stress however, that these are prices ‘as at this moment’ and I have seen higher - and lower - prices from the Virgin and BA websites for the same dates. That said, I rang Virgin and, as an ex-Oasis customer, I was quoted £420 per person at that time. I would obviously endeavour to find the least costly option.

    I would also ask that my expenses to and from Heathrow/Gatwick are met as I understand that legally I am entitled to be in the same position as I was before the demise of Oasis ie traveling to and from Gatwick. Unfortunatley I am committed to arriving/departing Gatwick as that is where I fly into/out of and it appears there are no other flight companies operating out of Gatwick. The cost for inter-airport transport is in total £140.00 which comprises two return tickets with National Express.

    Therefore, the total cost I am likely to be claiming would be in the region of £236 + £140 ie £376.00. I would however ask for a written assurance from yourselves that I may claim an amount for the cheapest replacement option I can find, rather than a set amount.

    Do you think that the reason you got your refund back so quickly, was because you hadn't actually paid them off yet...where as i have paid the credit card company already.
    The ticket prices are ridiculously high nowfor july-aug (the time i had planned to go) , so i guess being able to claim back the additional costs makes such a difference!! Do you have to book the exact dates as orginally booked??

    Just got off the phone to Nationwide about charging back my visa debit card with the cost of my flight and got told it takes 7-10 working days to process the request.

    Going to phone back monday as then it would be over a week since I called them originally to see what is happening so fingers crossed its good news.

    I will let everyone know how I get on, and will ask for names so if anyone here has a Nationwide Debit Card they know who to speak too.

    It doesnt matter how recent the ticket were purchase. It's all the same.IT's a credit "giving"card, so makes no difference.How quick the credit card decide to refund us depends on management attitude in verifying the facts. so if one has paid a long time ago, they would assume you had already traveled. so that is why they want to collect evidence from you and verify it!!

    in your correspondent to them end it with; " Statement of Truth" by ( your name) - legal talk to make them happy!

    I bought 4 new tickets on Air New Zealand ( direct to HKG) last week for travel for 23rd july for £625 each returning in August 20th. Up to a few days ago, that fare was still available on expedia.com IT's much better that ba, virgin and cathay.

    a lot of people dont know that air new zealand flies direct to hk and after oasis it was second cheapest to hk and miles better than ba or virgin. it has the largest pitch in economy class too!!!

    it doesnt have to be exactly the same dates but as close as possible and on comparable class.

    i hope you will get the fare i was quoted. you will get seat assignment at the same time of booking and their operators are really polite from new zealand.

    I tried looking on expedia ...but the price was still about 650+ ...what date did you book to come back in aug?

    HI,

    Sorry the exact fare was £625. Our return date was 20th August.

    £650 is still way cheaper than the other three by hundreds of pounds. i think cathay are asking high 800s.
    you forgot- we should be able to claim back from our credit card company the extra cost. we will get back our original cost.you dont have to save them that much money to rebook us to get us back to our original situation with oasis as govern by the law.

    remember we are not paying for the ticket twice.
