Stopped by Police Car insurance Problem. PLease Help.

  • I got a good ear bashing from a Headteacher on the DASH rehab course they offered me for Drink Drive conviction. Apparently it happens a lot and not everyone is as lucky as you, even tho it does sound you blagged it, well done!!! They seem to love the good old Drunk in charge so I hear.

    Please don't read anything into this other than the actual question as I have never been DIC and would never condone it, but

    Can you actually be ticketed for being DIC if you don't have the keys in your possesion?:confused:


    This is not meant in relation to any previous post other than being alone in a car when over the limit.

    Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

    The 14 days to receive a notice of prosecution doesn't apply in your case.

    They do have 6 months to summons you.

    I think you need to have the keys. In my case I actually had the engine running (stupid, I know) cos it was 3am and freezing outside so I had the heaters on. I was asleep in the passenger seat though.

    Ahhhhh, but you see, and this was where I was leading with this one, I know having the keys in your possesion was key to getting done. This was why people sleeping it off in the car used to put the keys behind a wheel then push the car onto the keys.

    But my car and I'm sure many other types have keycard ignition system which means I can start the car with the electronic key, throw away/post or dispose of the key in any other way. The car can then be driven untill the engine is stopped when it cannot then be started without the key:confused:

    I was just wondering what aspect of the law has this covered as I'm sure it will have been.

    James, a section uniform officer would not send through a file or report to the traffic dept for no insurance, it would only be sent hot footing it back with a do it yourself note on, as all that needs addiding prior to submission is a couple of forms, this has nothing to do with traffic.

    The section bobby would deal with it themselves through summons which means information must be laid before a court within 6 months, although this under certain circumstances can be extended.

    The car would have been subject of a PNC check and the officer who requested the details would have been given all the details of the vehicle, whether it was taxed, insured and Mot'd, also the driving licence details of the owner could be obtained.

    The owner also commits an offence of use, cause or permit the car to be used by an uninsured driver and so therefore could also be prosecuted. Did the officer take yours and the owners full details, name, address, dob etc, if so, there is no need for an HORT1 and you should recieive something within the next 6 months, but normally about three months.

    If you want to contact the officer, ring the call centre which takes non emergency calls, give your details and the car details, and they will be able to trace the officer who checked the car on pnc, they can also cross check the reason code which would possibly be linked to an ongoing incident, which the officer would give a mark off for and would be on the incident.

    The part of four police cars turning up makes one think there is far more to this saga then Hansel & Grettle could dream up, and the back up idea requiring four units is a non starter unless it was requested and why ? just for a car stopped at the side of the road?

    ummm, anyway, see how you go.

    Can't see you getting off this, driving without insurance is an absolute offence, expect to receive a summons.

    So is driving without road tax (albeit unknowingly - due to the wrong car tax disc on my windscreen, put there by the garage where I bought my car!:eek: ). But the police can and do make judgement calls -

    My daughter was pulled and nearly arrested for fraud - we had been driving around oblivious for 7 months with NO tax and the Wrong tax disc!
    The police do seem to use common sense sometimes - my dd ended up with a £60 fine for not displaying tax details, it could have been SO much worse.
    They can see who is telling the truth at first glance I imagine, how we managed to drive around for 7 months with no tax, I'll never know.:o

  • I have been reading this thread with lots of interest and thought that you could help with another problem.

    My sister loaned her car to my cousin for the day to help my sister's mother in law transfer some belongings from one property to another. My sister was unable to do this as she had to be at work that day. Our cousin is a long distance lorry driver currently working in Canada, been there for about 2 years, who had come over to visit. He had a loan car but used my sisters as it has much more room.

    Anyway, police stopped him and ran a vehicle check he informed them that he was not the owner but had the owners permission (sister's husband was also in the car), it turned out that his insurance covered the loan car only so now they have started court proceedings for him driving with no insurance.

    However, he lives in Canada!!! My sister has phoned them to try to explain this but they are insisting that he comes back from Canada to go through the court proceedings!!!!!!!

    Does this make any sense to anyone? Even if they give him 6 points and a fine (which seems to be the norm) it won't affect him as he does not live in the country.
