    Listen the officer made you sign something. Was it her notebook??? Or was it a page where she wrote answers and then your replies to the answers??

    Let me know cos this is very very important.

    Alot of people seem to get confused with the term cautioned. When I say cautioned I do not mean getting a slap on the wrist caution but I mean that when you are told your going to be reported to the CPS for an offence or about to be arrested (and taken back to the nick) then yoiu would be told "you do not have to say anythiong but I must CAUTION you that if you do not mention when questioned something you later relay on Court it may harm your defnce" This wee speech is called the CAUTION.

    The CAUTION refers to the guidlelines Police must follow when arresting someone or telling them they are going to be reported for an offence. The CAUTION means if you say for example you tell the Police after been read the CAUTION "yeah I was with my mate down the local" when Police think your the one who just robbed an old lady and police later find out your not on the pub cctv and 10 witnesses say your did it then the court will be told your a liar basically!!

    I just had a read of the whole post again....

    Your going to get a summons. After caution ie the "you do not have to say anything........" You admitted to driving with no licence and with no insurance.

    If it was me I could see a prosecution for the following offences -
    (1) Driving with no insurance
    (2) Driving with no licence -

    I could see the owner of the car (your mate who was with you) being prosecuted for
    (1) Permitting no insurance (allowing you to drive uninsured in his car)

    If you dont have a licence to drive then I can see you getting a ban until such time as you pass your test and the possibility of points when you do! IF you have a licence and just didnt have it on you then I can see a fine and 6 points or more.

    We both were questioned and i was making conversation with them, they did talk us down, for example one officer was being sardonic by saying, "ooooohhh thats 6 points and £200 fine" and he also said we can inpound the car i was driving, but they didnt impound the car. This was my first stop from the police, and i personally think that they may have been scaring me.
    But very hard to notice because the police do not bluff

    She made me sign the conversation she recorded which was only 2-3 questions, however it was in her small black notebook. I think i was caution as she did say that quote, Anything you may say can be used against you if it gets to court etc etc. but i didnt reply any comment after that. I do have a UK licence but no insurance on the car. 1 more question though,
    If they are going to do me, Why didnt they do it their and then? When they know i was breaking the law, they had every right to impound the car, tell me to go police station within 7 days, they could have given me a fixed penalty? Im confused with the procedures they followed...

    IMHO (speaking as an ex policeman) It is highly unlikely that you will hear anymore about this as from what you have said it has been dealt with at the roadside. I MAY be wrong (it has been 7 - 8 years since i left the force but i do still keep intouch and keep up to date with changes etc). But from everything you have said i would say you have got off very lightly indeed, the could (indeed SHOULD) of impounded the car as you had no insurance.

    To put your mind at rest, why dont you ring your local force, quoting the date and time you were stopped and also the reg no of the car, and the operator will look it up and find the relevant incident and locate the officers that dealt with you, then they will e mail them a mesg to make contact with you to update you with what if anything is going to happen to you.
    The officer who spoke with you should have said if they were goiing to report you or not?

  • DON'T phone the police! They may have lost the notes/got disorganised/got distracted by a box of donuts/etc and ringing them up is surely just asking them to remember.

    Just sweat it out for a couple of months and if you've heard nothing it's unlikely you will (although not impossible).

    You are assuming that an incident was created on the computer system. Not all police work is logged on the computer system. Just as not everything a police officer does is logged. If an officer stops a vehicle and just has a chat to the driver (because the driver is pleasent or the officer is in a good mood), perhaps tells him his brake light is not working correctly and to get it fixed, and does not issue any paperwork, the only place this is likely to be recorded is in the officers notebook.
