Stopped by Police Car insurance Problem. PLease Help.

    Hello, Yes the police woman did say "You do not have to say anything but it may harm your defence if you do not now mention something which you later rely on in court. Anything you do say may be given in evidence",

    but she didnt say "You don not have to remain, you are not under arrest and you may seek legal advice should you wish to remain".

    Also, i was searched, my friend and his car was searched, but they didnt give us a stop and search form "Producer"

    I did not have my driving licence on me, but i told them i had a licence and i told them my details and it seemed to me that they checked it, She even asked me how do i know this is your correct details, i said, i can show you my house if you wish, I think she believed me as i was talking respectfully and making them laugh abit. Also i did not lie with anything i said.

    What do you think may happen with all this said.

    Being honest James... you were cautioned by the officer ergo she can prosecute you. Did you make a reply after the caution i.e. did you say "yeah I have no insurance!" Cos if you did thats all she needs to get you convicted in Court.

    I wouldnt worry about this. Its just a bit of an add on for persons not being taken into custody or voluntarily attending a police station for interview. It just points out your not under arrest.

    Also, i was searched, my friend and his car was searched, but they didnt give us a stop and search form "Producer".

    Under PACE which covers Stop and Search powers they dont have to give you a copy of the search record. However at the time BEFORE the search commences the officer searching you and the car must tell you the grounds of the search (eg you were acting suspicously in an area known for drug dealing and they are gona use the Drugs Act to search you), the object of the search (Find drugs) Identify themselves (name and station) tell you that you are entitled to a copy of the search record... and ask you do you want a copy of the search record.. if a search record cannot be completed at the time you are entitled to apply in writing to the HQ of the force were you were stopped within 12 months for a copy of the record.

    James... lift the phone bud... seriously lift the phone.. contact the officer who dealt with you and ask them out straight what she intends to do. If its a case they are going to take you to court ask can you opt for the £200 ticket with 6 points??? if you dont ask you dont get!!!

    Hi James, Forget the term "ergo" as it just means it's a word used as a sentence connector (i.e. "you were cautioned by the officer (therefore) she can prosecute you". I'm still with you on this one. It sounds as though you're being given help and advice from someone 'in the know' here so I'd advise you take it and ring the Police Station and ask to speak to the (female) Officer who dealt with you at (place) on (day, date, time etc). However, having said that, I see you don't appear to have the relevant info, so are you saying you weren't given any paperwork about the incident to keep for the means of contacting them? If not, then (depending on what "thesecretpolicemansball" says tomorrow) phone the Station concerned and give all the relevant details of the incident and ask could they kindly advise you what's happening. They'll have records of the event and should be able to help you, or, hopefully,let you speak with the Officer concerned. This is just to help until hopefully "thesecretpolicemansball" replies tomorrow. Take care and keep smiling as it won't help to do otherwise! Sue

  • Did you give the officer any ID? credit cards etc? If so they will have a positive id on you and it's not your younger brother etc. If not then they really don't have much to go on which is probably why you were put under caution until it was obtained.
    If they were going to prosecute you then they would also prosecute your friend for allowing you to drive his car knowing you should not!

    You obviously were not worth taking to the station and probably not worth there paperwork. You may receive a letter in the post regarding a written warning which can be used against you if you do something wrong in the future. (I'm on a warning because the police car could not catch up and when he pushed it 120mph I was doing 70mph so absolutely no way of proving it.)

    From what you said it sounds a genuine case of being in the wrong but you may have had an officer who seen how white you were on the night and given you a break. If they gave you no paperwork then put it down to experience.

    I would not ring the officer as it’s like saying “give me 6 points, a fine and possibly instant removal of my licence” if you have less than 2 years with a full licence.

    Just move on with life!!
    Lets get this straight. Say my house is worth £100K, it drops £20K and I complain but I should not complain when I actually pay £200K via a mortgage:rolleyes:

    Can't see you getting off this, driving without insurance is an absolute offence, expect to receive a summons.

    When the police lady cautioned me, I didnt make any reply as i just sat their quitely and she made me sign the conversation we had. Which was only two questions, Do you have a driving licence and are you insured?

    No, i was given Nothing at all (no documents) from the officers, All she said to me at the end was, this will be sent to the traffic police, As they seemed confused in what to do, and she also said to my friend "Dont let him drive again, insure him"

    I didnt have Any id on me, i just verbally told her my address, i didnt have my wallet to give her any card. And they also told my friend he might get 6 points aswell

  • Get yourself and your friend together, did you feel like you were both getting a talking down or questioned? Did the officer just try (and obivosly has done) scare you both or did they write down every single detail? From your typing it seams like it was your first run in with the police so don't really know how to react.

    I know what to expect in the back of a police car and this only comes with experence. (no points ever in 10 years and I've been pulled more than most)
