Stopped by Police Car insurance Problem. PLease Help.

    Iv'e kind of been following this thread and now I think is the time you should just call up the station and find out once and for all if you are being prosecuted or not.
    I do think the same as you though that if he let you go you are probably ok but I'd now want my own peace of mind.
    Mind you, hindsight is a wonderful thing and personally I couldn't have had this hanging over me for so long.

    Do as Shelley and the rest of us have been advising you to do all this time - ring them up and ask to speak to the officer who dealt with you. To do that all you need is the time, date, vicinity where the offence took place.

    I can't understand you not telling your family James, the truth has to come out one day if your summonsed and from what the chap here said yesterday, you'll be lucky not to be. The truth will spill then and most likely you're family will feel they couldn't be trusted or be there to help you at a time when you needed it.

    As for the insurance if you stop driving which you obviously should, I think you'll now have to forfeit that, though someone may come on and tell you differently. It's often said that things happen in threes James, so let the driving go before that third event happens - please!

    OP to be frank the thread has been difficult to follow and confusing because the relevant facts have only emerged in dribs and drabs over many posts but taking into account everything that has emerged I would be flabbergasted if you do not get a summons.

    You were identified (therefore no need to arrest you and drag you down to the station). You signed to confirm the offences and the police told you the case would be passed over to traffic. If any more information is needed (seems unlikely), you will be contacted by the police at some point otherwise you will get a summons.

    I would guess that the police database would only hold information on previous convictions and criminal activity, outstanding warrants for arrest etc. After all, technically you have not been convicted yet. Possibly it would hold pending convictions only but these may take some time to be added? I’m only guessing here though.

    I don’t know what the penalties are for driving without insurance but if you have passed your test within the last 2 years and end up with 6 or more points, you automatically lose your license.

    An endorsement of this type (IN10) would stay on your license for 4 years but many insurers ask you if you have had any convictions within the last 5 years.     It’s a tough lesson, no doubt about it but it’s even tougher when your on the receiving end of an uninsured driver.

    Several years ago, my fathers car was rammed in the left side whilst he was negotiating a roundabout. My father was left trapped in the car with back and neck injuries whilst the uninsured, banned, drunk driver got out of his car and with the help of his friends pushed his car down the road and back home before the police arrived. Fortunately, two witness stopped. One stayed with my father whilst the other followed the people pushing the car to see where they went. My fathers car was written off – the force of the impact so severe that it was jammed in 2nd gear and had to be recovered. Because the fault driver was uninsured, my father had to claim against his own insurance, lost his no claims bonus and had an outstanding claim against him for years until the matter was resolved.

    Not getting at you personally shelly. I've noticed there seems to be a common misconception running through this thread which has been mentioned time and again. As long as the police are satisfied with your identity and where you live, they are not going to drag you down to the police station for a motoring offence unless there are complications (your wanted, denying the offence, need to run tests for drink driving etc). After all, they know where you live and can drop in any time of the day or night.

    Its ok, I admit I have never been in this sitution so haven't a clue really :rotfl:

    Then again I know enough that I wouldn't have let it go on this long without knowing and I certainly wouldn't have accepted a car from someone and insured it without knowing the real answer to the question "Do you have any prosecutions pending?"

    The one thing you should be doing at this stage even if you've had a bit of a let off is to drive like a granny and gain a bit of driving credibility/NCB so you can enjoy a decent motor in a few years time.;)

  • 1. No Ho/RT/1 - a very good sign.
    2. The NIP does NOT apply, they have six months to summons you.
    3. DO NOT RING UP TO ENQUIRE - It might cause someone to do something.
    4. If summonsed do not muck about or try to pretend it did not happen unless you want a short prison sentence.

    You say your brother has insured you and you are a named driver (2nd driver) if it is your car and you are the main driver this is illegal and known as 'fronting'.

    Hey, haha, Nah, i was at a roundabout with 3 of my mates, and i took the third exit, on the second exit i saw a police van, and it followed me, then it was behind me, i wernt breaking any laws. i was driving at 30mph and it just pulled me for no reason, i think the officer thought i didnt have no licence as i look young... but i proved him wrong and did a name check said i was clear and let me go.

    The car is on my brothers name and his the main driver, im just the 2nd driver.

    You know what the worst thing is, That i don't even know if i am on pending prosecution, i mean they never gave me no slip or anything! To be honest, i dont mind going to court well i actually dont want to obviously, but its just the burden of finding out what is going to happen!
