LXDirect Demanding Money Back - Help!

Hi, a friend of mine has received a letter from LXDirect Demanding Money Back because the vouchers he used, were mistakes. ???
They said they will 'adjust' his account.
What should he do?
Nick.

Nick,
This is only my opinion ;D, but your freind could do a couple of things.
1. decide if s/he wants the goods at the new 'adjusted' price.
2. if s/he does, then Keep the goods and pay the new rate.
3. If not, return the goods (if possible) to LXdirect.
I don't think that your freind has much legal comeback - although I have little/no real legal knowledge.
Unfortunately great discounts and loop holes don't last forever. Your freind might not be able to take advantage of this one, but there is always another around the corner! ::) ::) ::)

When the deal is done and LX have taken payment, doesn't that complete the contract? Surely they aren't allowed to change their minds and charge more than was originally agreed between the two parties?
I am going through something similar with LX right now, although they didn't even have the grace to write to me!Much of the social history of the Western world over the past three decades has involved replacing what worked with what sounded good. - Thomas Sowell, "Is Reality Optional?", 19930 -
You'd think that once they take payment and deliver goods, then thats it - but 3 months later, they demand more money. Surely this is illegal? Regardless of how we obtain codes, is it not the responsibility of LXDirect to check before they accept them?
Is there anyone with a legal background that can shed some light on this?
Has anyone successfully overcome this problem?

Loafer, I think the situation is reversed. LX are actually debiting people's credit card accounts with the money they feel they are owed from what they call the misuse of codes. They've got the money from the client. Now the client is trying to get it back from LX.
The OP by NickA is unclear on this point, but he does say that LX will "adjust" his friend's account. That may be a deferred payment account. Not sure.
Could do with a few more experiences from other people here.Much of the social history of the Western world over the past three decades has involved replacing what worked with what sounded good. - Thomas Sowell, "Is Reality Optional?", 19930 -
I, along with many others have purchased items from LXDirect with the use of discount codes. LXDirect took the money and delivered the goods. They take the full amount and then credit your account with money depending on the code used (as you all know). I have the emails showing the final price of goods including the vouchers.
The problem now is that LXDirect want the money they credited - back (£15, £10 etc etc).

Nick,
Sorry I didn't realise that the payments were coming off THREE MONTHS LATER!
I think that is ridiculous, as no doubt you are not able to return the items due to use/consumption etc.
I would be tempted to go with your freind and visit the citizens advice Bureau. They'll be able to tell you your legal position.
Also a letter to trading standards might not go a miss. Even if it is just asking the question, rather than an outright complaint. ???
Good luck, and please let us know how you got on. From the other boards, it is clear that others are in a similar predicament. :-/

okay, this is quite worrying.
ive just ordered 2 items, and got £19 off altogether and now i dont want them coming back to me, coz the items were more expensive from lxdirect than most other places, i just bought them there coz of the vouchers.
what am i to do if they come back... if anyone has more information, please get back to me!!!
surely them taking more money off you than agreed is illegal?
i never gave a fone number, coz i live with my parents... but what we do here surely is legal (sharing voucher codes). is there anyone who can shed a legal view?
cheers

ive just checked the site for terms and conditions:
paragraph 2, point 3:
Where you have used a promotional code to obtain a discount off the price of your order, acceptance of this order is subject to our verifying that the code has been issued to you personally. In the event that the code has not been issued to you for your personal use, the price of the order will be adjusted notwithstanding any email confirmation which you receive.
but i cant remember confirming anywhere that i agreed to the terms and conditions?0 -
If they do send the items back and tell them to stick it where the sun dont shine
They dont have a hope in hell.. just make a complanit to your visa company!0 -
I wouldn't lose any sleep over it, mistymountainhop. I'm sure we've done nothing illegal. They just annoy the **** out of me! At the very worst, you're going to be £19 worse off, but they are not going to bring legal proceedings against you for that amount, even if sharing the codes WERE illegal. They'd lose, anyway.
They've got it wrong again today with me, too. I had arranged for this blessed camera to be collected today, and no-one turned up for it. I hate that!
So they've got another snotty email.
With all the details I've put on here, they probably know who I am. If so, may I ask them for the courtesy of an apology and an explanation for their actions?
