  • As I had already paid my mcol fee and court fee I decided to turn up to my judgement today. And as I already knew the judgement was found in my favour.

    Was it decided that we couldn't claim back off the directors?

    I've read loads of conflicting info on the last few pages so can't figure it out. I understand they have gone into administration - but from what I can gather we still won't get paid that way either. So is there any hope of getting the money from the directors?

    I don't know whether there were or not.

    But by that date they had adopted a different tactic when dealing with warrants.

    They were telling the bailiff they intended to appeal the judgement, and consequently the bailiff came away empty handed (there is a post in January reporting this).

    No personal callers have reported getting paid when the money involved was the subject of legal action.

    Presumably they paid off personal callers to avoid any unpleasantness. But as far as paying off warrants, then their tactic of saying an appeal was planned was a legal reason to give to the bailiff for not paying up.

    I was attempting to point out to you that unfortunately (unknown to us) the death was imminent on 2/2/08, and (with the benefit of hindsight) any warrants issued at that time had no chance of getting satisfied before the final demise.

    In any case prior to this, caution was urged towards anyone contemplating spending any money on any form of legal action.

    T-Mobile are saying my contract is from Chitter Chatter (a TMO supplier?), which according to them is an ongoing company, can I claim from them instead?

    At the top of your contract, does it say the contract is with TMO or Chitter Chatter?

    No.

    Nor is whom you bought the 'phone from relevant to your contract with T-Mobile.

    It was The Mobile Outlet, and nobody else, who offered to rebate it via cashback - and they are gone.

    For what it's worth:

    Everyone with unpaid cashback is a creditor.

    If a creditor wants to register their claim (ie as a creditor, not their cashback claim) with the administrator, then they should register the total amount owed.

    Thanks for that - I've only read the last 148 or so pages. I recalled from page 91 that their registered office address was given as
    3 Brander Close,
    Idle,
    Bradford,
    West Yorkshire.

    On rechecking that page I see that you gave the Valley Parade address as the registered office then.

    Now they are in administration their office address is the Administrator's.

    Bailiffs cashed the cheque yesterday. Today I received a letter saying they have ceased trading/werent at the adress given. I was about 1 week too early to send off that cheque :(
