Can I claim in the small claims court for the estimated cost of repairs to my vehicle using new parts as it would have been new parts used if EH had not breached the warranty, or am I only entitled to claim for repairs with used parts as I could no way afford to pay for new?0

I had my vehicle repaired using used parts as Evans Halshaw breached warranty and would not pay for repairs.
If they'd have repaired it the parts would have been new.
I got quotes for repairs with new parts but I could not afford so opted for used parts.
Can I claim in the small claims court for the quote of repairs with new parts or only for what I've actually paid even though if Evans Halshaw had repaired it the parts would be new?0 -
You can't claim for costs you haven't incurred IMHO. Repairing a used car with used parts is like for like.0

Thanks, but I wouldn't have had to repair it had they not breached the warranty... The issue is that the fault was already on the vehicle & they have not yet admitted/accepted this. Had they repaired it they would have used new parts as they quoted me.0

We bought a peugeot 206 1.4 ac 05 tuesday 12 july 2011 after two days we herd a swishing noise from the engine we asked someone about it from a friend and he said it sounds like a trust bearing going we phone evans halsaw up 25 july we took it in and most of the people said it sounds like the thrust bearing going so why didnt they tell us when we bought the car at the first place which we got a mot and tax with the car now we got to take the car back monday 1st aug 2011 for repair they offered me a courtesy car but coudnt get one due to not having driven for a year now they shoud compensate me for not driving the car for two days WE NOTICED THE WING MIRROR CAP ARE DIFFEREENT ONE AS GOT GLOSS EFFECT THE PS SIDE LOOKS LIKE A REPLACEMNET SO IT LOOK ODD0

Evans halshaw Cardiff owe me £90 for diagnostics they charged me when I had an extended warranty. I complained to Pendragon Contracts who agreed I shouldnt have been charged for it...told Evans Halshaw to refund me but we havn't heard anything since despite more emails. Worst bit is that when I disputed the charge at EH in Cardiff, I was told that I was welcome to complain to Pendragon but that they always came back with the same advice...diagnostics are not covered...which is an absolute lie!! Pendragon seem annoyed that Evans Halshaw Cardiff have been using their extended warranty contract in this way! Any advice how to get my money back from these people??0

I would contact Consumer Direct through their website. They will take notes and then a Trading Standards officer will ring you back. It might be worth writing to the head of Evans Halshaw if you can find a name.0

Im currently having problems with Evans Halshaw in kirkcaldy, Fife. I purchased a brand new car and the body work was damaged on arrival, they have had two attempts at repairing in the past 17 months and the last attempt damaged the car further. I paid 37000 for a limited edition car thats now worthless.
Its a very long story but did anyone have any luck contacting Pendragon direct? the last email from the dealer principal states that he is in touch with evans halshaw legal team.....kinda felt like a threat.....0 -
