rayday, he will be an adorable addition to the family. My first dog was a black labrador and I still miss him. We now have a beautiful cocker spaniel who is completely and utterly BONKERS! And this little chap has helped me through some really stressful times as it's amazing the comfort you gain from a dog. He is my best mate and I love him to bits, despite him driving me to distraction sometimes!
I've been baking again, OH is loving it (although his trousers are getting a little tight) .. a few weeks ago Tesco were selling Bird's Chocolate Trifle at 10 pence a box, so I stocked up on a few and made my first one this afternoon. Mind you, the custard looks a little like wallpaper paste!
Regarding Lloyds, they are playing silly beggers with us at the moment, but we are hanging on in there. What else can we do? And NW are being a pain but the remaining creditors have accepted DMP and frozen interest etc (incl. MBNA which surprised me somewhat).

Well so much for me saying it was quiet on the creditor front
I was thinking the same then some letters came through the door today which is typicalOne from Barclays saying that they will wait to hear from Payplan, and another for a creditor who hasn't had my letter to them by the sound of it so I need to write to them. It does seem that some of my letters have got through the system, so far the only replies I've had have been to say they will wait until Payplan gets in touch. I have written again to MBNA/Alliance and Leicester/Optima Legal or whatever incarnation they are using at the time to remind them I am going through Payplan - so far they are the only ones being difficult.

Yes - Mercers are Barclaycards in house DCA. From what people on here say, they are just made up of Barclaycards "top" collections people.
In my case they sent me a letter after my DMP had already been accepted by Barclaycard threatening legal action etc. I pointed out that I actually had an agreement already and haven't heard a thing since.LBM : March 2008

Hi everyone Lloyds CC are such a pain im getting really fed up with them now .
My two loans and overdraft was accepted straight away when i went onto DMP but the credit card they said the payment was too low so they rejected it .CCCS said not to worry they have been sending my payments to them anyway .
Every Saturday is the same for me it has happened 3 weeks in a row i get a letter from Lloyds CC saying they have never heard from me and i must think that the debt i have with them is low prioty ,i must contact them immediatly so they can deceide how to deal with my account .
Every week i ring them and have the same conversation they say the have never heard from CCCS and the ask me to contact CCCS and tell them to ring Lloyds .CCCS have sent my income & expensiture 3 times now to them because i have asked them to do so ,they are also getting my payments from CCCS but they still say they have heard nothing from them .
What should i do ?I am back and forth from Lloyds & CCCS saying the same thing .Lloyds CC say if CCCS rings them they will accept my DMP but CCCS dont ring them all they do is resend my income & expenditure .
Is this normal as to what creditors do ? It is early days yet on my DMP Lloyds have only received a few payments from me ,cccs seemed to think when they have received more payments they will accept .0 -
Update with my DMP. 3 of the creditors have accepted my repayments. 2 yet haven't. But... today (and always happens on a saturday!) I received a solicitors letter from one of them. This creditor hasn't even transferred to a debt collection agency which i was expecting. The letter tells me that the repayment i have offered through my payplan DMP is not acceptable and legal proceedings will continue if this is not substantially increased. They are also asking me if i want to consider a voluntary legal charge to secure the debt on my property. I'm not sure what this means.
Any advice would be very much welcome.0 -

With regards to the increase of payment - ask Payplan to resend your income and expenditure lists and advise the solicitors that this is all you can afford.
With regards to a voluntary legal charge this is commonly known as a charging order against your house - so in effect the creditor turns the debt from unsecured to secured - I would strongly recommend that you fight against this initially. They can't force you to sell your home if there is a charging order against it and all it means is if you sell your house, any equity you have will go towards paying off your debt.
I would just be firm, explain this is all you can afford and see what there next steps are.

The arrears that they state are wrong. The default notice they sent required two payments of which I paid one, so the arrears to which they are referring are incorrect - I don't suppose this matters?

With regards to the default - I would definitely get this amended - write back to them and advise that the information they have provided is incorrect. I'm not sure if it matters but as it will go on your credit file I'd definitely want the correct figures stated.
I had a similar experience recently - the date when they issued the default hadn't included payments I made - they ended up taking me for a CCJ - but I was very clear on all my paperwork and with the judge that the amount they stated was incorrect - which I believe then went in my favour.
Not saying that yours will go that far, but I'm getting a bit of a stickler now with creditors :rotfl:
