    Hi Lou

I'm still shattered! And I've still got all the clearing up to do, left it last night and went to bed!

I think the last few days of waiting are the worst, you really do feel like you are going to combust  :rotfl:

I'm trying to tell myself not to get in the same state with the next claim but I'm not sure I'll be able to manage that, I'll probably be the same then!

Sun isn't really shining here but it's not raining either so that's a good thing!

    Hi Sam

You havent got long left now have you ,probably the best thing to do is not to expect to hear from them on time and then you won t be disappointed.

    Have you chase them yet?

fingers crossed for you to hear in next week or two, no need to tell you the drill as you ve been there and got the t-shirt:rotfl:

Very quite on here at mo, not heard from amelia, think shes out spending. trace is on holiday for two weeks as well.

My friend sent her first letter to HSBC claiming £1133 in charges. They've replied within 14 days and enclosed a £50 cheque!

    Now what?

Apparently the letter says that they consider their default charges to be reasonable. They have lowered their charges since the recent court cases but this doesn't effect any previous charges. However, as a goodwill gesture and only if my friend agrees not to make any further claims they enclose a cheque for £50 (without prejudice).

The letter ends that if she isn't satisfied she must reply within 8 weeks.

I don't think she should cash the cheque but send it back and ask for the full amount...what do you think?

    HIYA:D

She should keep going send letter saying that she will accept the £50 as part payment but will still be claiming the remaining amount. State that they have eight weeks from the first letter date. Thats what i would do. If you want to claim the interest and stick to your timetable of 2wk before court action then thats up to you but personally i would wait the eight weeks.

When was the original letter sent?

She sent the letter 3rd July, their letter back is dated 6th July but took until Wednesday 18th July to land through her letter box!

Is she OK cashing the cheque or does that mean she's agreed to the terms in their letter?

    Hi Lou

My 8 weeks is up 31st July so I am going to ring on 24th and then follow up with an email like last time and hope that it brings me an offer letter! It's my son's 13th birthday on 31st August so I really need the money in plenty of time for that so he can have the party that he wants _party_ !

Are you staying up tonite to check? I shall probably be up quite late tonight, my son has his mate for a sleepover so they won't be going to bed very early!!

I'll check in later, see if you are around.

i wouldnt push for the interest too much since legally, they dont have to pay it but id try and get the full amount. £50 is laughable. imagine if u had a loan of £1,000 with them. if you said ill only ever pay £50 off that they wouldnt accept it, would they?

    HEAR HEAR!!

HSBC are a joke really. I have said time and time, and I'm sure others agree with me, there seems to be no rhyme or reason or consistency to anything they do. They take different amounts of time to pay out, they pay out different percentages of claims and they vary the time it takes to pay money into accounts!! :rotfl:

Like you say, it would be a different story if we treated them the way they treat us!!!
  • can anyone help me got a general form of judgement or order through the post this morning says....upon the courts own motion.the court has made this order of its own intiative without a hearing.if you object to this order, you must make an application to have it set aside, varied or stayed within 7 days of recieving it. it is ordered that unless the claimant by august 15th files at court AND SERVES ON THE DEFENDANT futher written particulars of the claim specifying the name, account number and sorting code of the account referred to,and a list of all the charges complained of showing the date and amount of each one and the stated reason for it,the claim shall stand struck out without futher order...... what does this mean?anyone got an idea?
