  • OK, this is what I sent them:

    Hello,
    Two of my orders (########### and ##########) have been cancelled, due to the items being out of stock, but the items are still in stock, as the same Marketplace seller has them currently listed. If the items are in stock today, and my order wasn't due to be dispatched until tomorrow, then clearly there was no need to cancel the orders. The e-mail suggests that I should return and re-order the items, but they are now being offered at vastly inflated prices.

    Given that Marketplace terms say that:
    "The seller is obliged to sell the items at the listed price to buyers who meet the seller's terms"
    and
    "A seller may retract an item listed for Fixed Price Sale at any time but is bound by any offers accepted prior to the retraction"
    and the confirmation e-mail says that:
    "For items purchased from third parties in Marketplace, zShops or Auctions, this e-mail confirms the completion of your contract to purchase those items"
    and that the items are clearly NOT out of stock, I would like my orders to be fulfilled as per the contract.

    We're sorry, but the following order from E and G Direct (Electronics and Gadgets Direct) has been cancelled because the items you purchased were out of stock.
    I have to wonder if that’s an automated message. Given all the different things they could have said, that was a particularly stupid choice, if they did indeed choose it. So, it’s out-of-stock. Tough, the contract still stands, and they need to make their best endeavour to fulfil it. It’s not like the manufacturers don’t make the products any more and that something comparable couldn't be obtained from elsewhere.

    They should have just told it as it is. That, due to a major error, a large number of prices were put up that were grossly incorrect. That no-one could have reasonably expected to get a £200+ item for £25. If anyone’s ordered something that’s still being sold for a price that’s closer to £25, they could perfectly well stand their ground. It’s not unreasonable to believe that an item that was previously being sold for £50 could have been discounted to half-price.

    Here's the full list of T&Cs for marketplace sales. So far, I think Section 3 and 1.4 seem relevant to this situation.

    If E and G Direct had just been honest, I wouldn't have cared. I wasn't expecting anything to come of this. It's the lie about stock levels that's annoying me...

    Isn't all of this the expected outcome? There's probably a list of options for the sellers to choose to explain why they are not fulfilling the order. Doesn't really matter which one they choose.

    If I was the seller, and I fulfilled these orders, I would go bust. They aren't Amazon or DSG, just a small business.

    Noone is going to get these goods at this price. Amazon will not help you. You can't leave feedback. And even if you could, they would take the feedback rather than going bust by being silly in sending out items way below cost.

    Noone has lost anything - everyone knew it was a pricing !!!! up. So, save your time, fingers, phonecalls, hopes of meeting Nicky Campbell, and carbon emissions by moving on!

    (I'm talking about putting aside the legal ins and outs, whatever qualified or barrackroom lawyers on here might say and letting common sense prevail)

    I ordered one of the bread makers, before discovering they had messed up some of their prices.

    As you probably know they were up for £39.99 recently, so was looking out for them being offered again as I missed out. It didn't therefore seem that strange to see it up for £32 delivered.

    They are being offered as available by E and G right now, so the stock garbage is a real fob off.

    I've emailed Amazon and the seller. I'd be happy if Amazon just offered one at the previous offer price as a settlement.

    This place should be called moneygrabbingexpert.com, not moneysavingexpert.

    If a company has made a genuine and very obvious mistake, but realised before you managed to exploit it, why should they give you any sweetener, as someone suggested above? Why should they get negative feedback?

    I realise that that is the way peoples' minds work these days in our compensation culture but you were trying to exploit a very obvious !!!! up in the first place - which, for me, isn't far off theft, albeit in some circumstances supported by consumer law (which itself is too consumer biased in my opinion).

    I know this doesn't apply to everyone here so I'm sorry if you get caught in any crossfire.

    I can predict the replies to this post (wahhh it's only my RIGHTS I'm after) and I apologise if this thread degenerates off topic as a result.

    Not so. If you heard about and ordered knowing they had goofed, yes. But not everyone who ordered was aware they'd messed up.

    Yes, that's fair enough. No-one was actually expecting anything to come of this. The problem is that this seller has taken the time to cancel everyone's orders, but couldn't be courteous enough to send a standard email to purchasers apologising for the error in pricing. Yes, they would have been massively out of pocket if they had fulfilled the orders, and I'm sure everyone would have shrugged off the cancellations if they had just be polite enough to do this.

    Basic customer service costs nothing...

    Your £32 breadmaker is feasible, but the other stuff, probably not.

    Either way, there is no way E&G is going to fulfil the order, threats of bad feedback or whatever have no bearing on this.

    Agreed that saying "out of stock" is wrong, perhaps it was all they could choose from some standard form as I said. I don't know how it works, or indeed even if they have direct contact email addresses of users provide to them.

    I think you'll see the equivalent of a member being thrown off eBay for breaking the rules as the worst outcome plus Amazon changing their Ts&Cs or compelling/allowing sellers to communicate this type of thing to buyers.
