  • Note, though, that Amazon's T & Cs and confirmation e-mail are different for marketplace purchases.
    The confirmation e-mail for marketplace purchases explicitly states that a contract is in place, and the Marketplace T & Cs say that:

    The seller is obliged to sell the items at the listed price to buyers who meet the seller's terms
  • This seems to be an interesting one, I read those and it does seem that they have to sell at the stated prices if a contract is in place.

    We shall see if any of us get the kit at those nice prices.

    But it's not a *legal* obligation. If the marketplace seller reneges on the deal Amazon can,as a last resort, hold onto their funds and even permanently kick them off the site, but they can't actually compel them to supply the goods.
    Lots of sellers on marketplace underprice - either through ignorance or software error - and most will honour the sale for fear of garnering bad feedback. So there are always bargains to be found there if you're willing to take a small punt.

    I wouldn't count your chickens - there have been countless times on this forum when we have expected to get something, but the seller would not deliver irrespective.
    You don't get medals for sitting in the trenches.
  • It is one of those wait and see what happens. I don't think I will get my order, but who knows.

    I haven't started counting my chickens that is what I have found on the websites about trading and contracts of sale.

    A contract has been agreed.

    The difficulty is that a legal obligation often cannot be enforced without spending more money than its worth. Being legally entitled to something doesn't mean you'll get it, but nevertheless, if as a seller you enter into a contract, then you are legally bound to honour that contract, whether or not you actually do honour it in practice.
  • Amazon have just cancelled the order saying the products are out of stock and please order again, if though they say they are in stock at different prices.

    As far as I know, the contract - legally - is with Amazon, not the marketplace seller.If someone would like to trawl through Amazon's T&Cs to prove otherwise, I'm happy to be proven wrong.
