They have the facts so have a choice between refunding within 14 days or disputing the facts (by attempting to gather alternative evidence) which must also be done without undue delay.
8 weeks is undue delay, especially as they are only going to write to you after that period rather than spending that time arranging to collect and inspect the sofa.

If they could avoid paying a refund simply by not agreeing that you were owed a refund they could delay it indefinitely. That can't possibly be what Parliament intended.
Once you sent them the independent report they had all the evidence they reasonably needed to agree to a refund. Any further delay on their part is unreasonable.

If that fails, i am fully prepared to take the court route, should i do a letter before action as well, just to cover all bases 😎

I would see if that message obtains any kind of response and if it doesn’t after 14 days personally I’d be tempted to send a LBA.
I would assume v12 are hoping SCS will either refund you or fob you off so the matter drops, either way they basically hope not to have to pay you from their pocket which isn’t acceptable in my view. (It would be fine if they got SCS to refund you straight away but clearly that isn’t the case as they want you to hang around for 8 weeks).

If memory serves me right the Financial Ombudsman case took much less than 8 weeks in my case with an excellent outcome, damaged sofas collected and full refund given. You have provided them with all the evidence they need especially the damning independent report. I would not send a letter before action just yet and please be aware that a small claims court case would take months anyway. I hope all goes well for you OP.
