Thanks for your your reply.Coupon-mad said:"i deliberately don't update my v5 or the voters reg to avoid these situations,"Nooooo!
That is a REALLY REALLY bad idea and you could get several CCJs from firms who don't bother to do traces.
It is a really - really - silly thing to do. Stop immediately. Update your V5C this week.
Is it possible to sue anyone as with both PCN's i dont have proof of not being there for execesive periods of time. I live alone and have no witnesses or fanancial proof that i was not there. The claims are just ludicrious.
Do you have any threads where someone has sued an organisation.
I would like to sue these people but maybe its too complicated.0 -
It is too complicated for most posters so forget it and just defend the daft claim!
But action needs taking:
1. update your address with ALL debt collectors now, even those who have already traced the new address (yes, honestly it is still needed). Tell them to ERASE the old address.
2. update your V5C address with the DVLA and never leave it lapsed again. You are very lucky if you've so far escaped a private PCN CCJ.
Do all of the above this week/end. Including any DRA who wrote to you months ago. You cannot leave a parking firm with a choice of 2 addresses. That way lies a CCJ.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

this is the vile reply i got from HAlfords, they finally have responded tyo my offical complaint made on 6th Aug this year.I write to you further in relation to your telephone call this afternoon.Your case has been brought to my attention, and I want to assure you that we take matters like this seriously. I was sorry to learn of your experience and any inconvenience this may have caused.Following an investigation to your case, it is noted, our Car Park for our Manchester Fort store, is externally managed. And as such Halfords have no authorisation to be able to cancel and remove any parking tickets, for this site. Our Store Team have done everything possible to try and support with this matter, including personally contacting the parking company in which issued the ticket. As ultimately, the decision is made by the external party, Halfords have been unable to cancel this ticket. This is due to multiple correspondence being provided to yourself, relating to the fine.I apologise we have been unable to support any further on this occasion. Should you remain dissatisfied, I would politely remind you of your option to seek independent legal advice.0 -
Dear Halfords,
Private firms don't issue fines. This scam is an invoice and it won't be paid.
You are the principal (the 'organ grinder' in your ill-advised parking contract). The parking firm contractor is merely your agent. Why let the rabid 'monkey' run around off the lead, frightening away repeat customers?
You've lost my family's custom forever and according to social media we aren't the only ones. More fool your company for naively signing a dubious contract with a typically aggressive anti-consumer member of a known scam industry, and then wondering why your store is often deserted.
Even more fool you, for not ensuring the contract includes provision for Halfords to exercise a 'right to cancel' even a percentage of unfair charges, like supermarkets do.
Wise up. Your position is unjustifiable and plain stupid. Whoever signed this contract is losing you money on a daily basis. People don't return once bitten by a parking shark.
Whether you take that fact on board or not, in future, don't sign or renew ludicrously unbalanced contracts that expose your reputation to be dragged down to the bottom-feeder level of the private parking industry and don't make false promises to customers then renege on them.
I haven't discounted suing Halfords for breach of verbal contract (promise) and pursuing a "nothing we can do" course of conduct that continues to allow your agents to harass and intimidate me. You may be unaware but Halfords remain at all times jointly and severally liable for the actions of your agents.
You can expect a Letter of Claim in the New Year and for your staff to be called as witnesses. I would politely remind you of your option to seek independent legal advice.

Might be worth making a subject access request to Halfords to see correspondence relating to this sent by them?this is the vile reply i got from HAlfords, they finally have responded tyo my offical complaint made on 6th Aug this year.
Will show you how much effort they have put in and also whether they actually did direct cancellation but the parking firm refused. Evidence of that undermines any legitimate interest in continuing to enforce the PCN given the principal's wishes.3 -
You will only get the data they have on you with an SAR.
Also is this car park Halfords, or is halfords a tenant on a multi outlet retail park? From the Plain Language Commission:
