Did you use the normal template or you own as they normally never bother when they see mse type appeals

    Hi. I used this template:

I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Manchester Airport is not 'relevant land'.

If Manchester Airport wanted to hold owners or keepers liable under Airport Bylaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a bylaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. APCOA have no hope at ….

I did copy n paste the whole thing. I’m just confused as to the response that I’ve had from them. What happens now then as they’re asking me to either pay it myself or name the driver

  • It wasn't rejected.
So do I just ignore their response to my appeal - sorry I’m just really confused 😢

    yes ignore their response
They could be using it as they will be seeing hundreds of these types of appeals per week now
Just wait for their final reply
If we get more replies like this i will suggest to @Coupon-mad we change the wording to something more blunt that even APCOA can understand
  • Hello, advice needed. I received a letter through the letterbox today from 'debt recovery plus'. Apparently 'the time has come to decide how you wish to proceed regarding an unpaid parking charge from Manchester Airport T2 drop-off on 21.06 25.
I very rarely take anyone to the airport  so was not aware there was a charge or else I would have paid it. I've got better things to do than risk this nonsense over a few quids worth of parking charge.
Most of all though, the letter goes on to say 'you may not have responded to previous letters due to an oversight'....er, no. I haven't responded to previous letters because I HAVEN'T RECEIVED ANY!
This is literally the first I have heard about this.
And now I am being told I have to pay £170 to avoud legal action which I think is pretty scandalous.
    Can anyone advise?
    Thanks

You can safely ignore DRP. Nothing serious will happen. You might get a few more DRP threatograms, but they will fizzle out. Continue to ignore them.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the reply- is anyone able to verify or evidence if they have been in this position themselves and is this sound advice?
