    Hi everyone,

Just wanted to share my experience and thank all the contributors in this thread — your advice has been incredibly helpful.

My case is typical of what many others have described. On a recent visit to Manchester Airport, I accidentally took a wrong turn and ended up in an APCOA-managed car park. I was there for 1 minute and 24 seconds, just trying to find the way out. I even spoke to an attendant and explained the mistake. He reassured me not to worry and said he would ensure that no parking charge was issued.

Needless to say, I received a Parking Charge Notice from APCOA on 9th October.

After reading through this thread and following the excellent advice shared here, I submitted my appeal today via the APCOA website using the following text:

I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Manchester Airport is not 'relevant land'.
If Manchester Airport wanted to hold owners or keepers liable under Airport Bylaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a bylaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.
The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. APCOA have no hope at POPLA.

I’ll be back to update you on the progress of my appeal. Thanks again to everyone who’s contributed — your support makes a real difference.

    Danny

He knew exactly what was on its way to you. He had no intention (or likely ability to) to 'ensure no parking charge was issued'.  They say stuff like that to avoid any potential confrontation. Probably chuckling as you drove away!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
