PCN Whilst Using EV Charger Outside Permitted Hours - KFC Stratford Road, Hall Green, Birmingham

    But it doesn't matter if the OP gathers proof of no t&cs signs near the EV bays.

    I've already said twice on this thread "this is winnable with evidence photos" and that's what I'd try as the first point, if I was the OP.

    Yep.

    But I say again this is winnable with evidence photos: there are NEVER any contractual parking t&cs signs adjacent to special bays

    It's been a favourite trick for years for ANPR PPCs not to put any signs alongside bays where people are more distracted:

    - parent & child bays
    - accessible bays for disabled people

    ...and now EV bays are fair game.

    They know the person will read the terms for charging. They clearly hope the driver won't look for more t&cs so they just never put a t&cs sign right there.

    Clever scam. Only really clear when you start looking for signs & spot the pattern in retail parks. Entire disabled bay lanes unsigned but all other lanes do have a sign.

    Classic sharp practice. Same in EV bay corners.

    With photos to prove it, that's a winning appeal point along with saying Instavolt lease these bays in this corner and this isn't part of the managed car park enforcement boundary.
    So do you advise to appeal with the above image of the EV charger, or go and get a new picture of it? I totally appreciate and respect all of your knowledge around this it is really helpful. I would like to appeal as soon as possible so I can forget about it as I have some other more pressing issues to deal with. Please advise accordingly.

    1. Complain to Instavolt. Question: I have tried to find CEO e-mail address for Instavolt but it doesn't appear to be on the ceo email address website. Can anyone help here?

    No need for a new image. I already said how to appeal this, although you'll need to add the date/time metadata to that photo:

    But that is from their website not from a sign next to their charging point, I don't see how that can be evidence for the even on the day.

    Morning All, I submitted my appeal to POPLA last week and over the weekend received a notification that the operator had uploaded their supporting information. WOW. A 13 page document with chapter a verse about why I'm such a criminal etc etc etc. Then a 9 page document full of pictures showing the site layout and signage etc. They really have put the effort in. I have 7 days to provide my comments. I will upload screen shots of the response. All help very much appreciated once again. Thank you
