PCN Whilst Using EV Charger Outside Permitted Hours - KFC Stratford Road, Hall Green, Birmingham

I recently received a PCN from Civil Enforcement (www.ce-service.co.uk). The location of the alleged offence was in KFC on Stratford Road, Hall Green, Birmingham, B28 8HN. The terms and conditions of parking are outlined as "Exceeding the notified maximum free parking period of 90 minutes between 09:00am - midnight/failed to obtain a permit in accordance with" and them the box runs out so dont know what the rest of this section states.

The times of the alleged offence are 07:14 - 07:36.

The reason I entered this car park was to use the EV charger on the site due to very limited battery range left in my EV. Luckily I have proof that I used the EV charger there on my apple wallet.

The EV charger was automatically identified and navigated to by my vehicle, indicating it was available.

I have the screen shot of the transaction using the charger, but wondering if I have actually broken the rules by entering the car park outside the specified hours, even though I didn't technically use it to park, only charge! 

I have a little time to appeal this so any help is very much appreciated!

    It isn't an "offence" it's just a charge from greedy scammers.
    The newbies thread on here advises the first approach is plan A

    Appeal on the basis there are no contractual signs at the EV bays except for instructions from the EV charge supplier.

    And complain to the landowner to cancel it and ask what they are playing at. Get angry.

    You'll never pay this.

    Charging isn't parking, it is refuelling.
    Always remember to abide by Space Corps Directive 39436175880932/B:

    Morning all. Thanks for your responses so far, very much appreciated.

    Just for clarity, is the advice to take the following action:

    1. Appeal on the basis there are no contractual signs at the EV bays except for instructions from the EV charge supplier. Question: Should I actually check this out before I state this in my appeal?
    2. Complain to the landowner. Question: How do I know who the landowner is? Is it KFC?
    3. Complain to Instavolt. Question: I have tried to find CEO e-mail address for Instavolt but it doesn't appear to be on the ceo email address website. Can anyone help here?

    1) your choice,  but pictures and good information or facts always help win cases

    2) although it could be KFC, I doubt it,  more likely that they are a tenant

    Copy the complaint to InstaVolt you were parked on the bit of land they lease.

    You don't need to check out the signs yet but going to get evidence for second stage appeal is a good idea. Can win an appeal.

    I'm telling you there WON'T be any contractual parking signs in the spaces leased by Instavolt so you don't need to check.

    We know what these firms do.
