Thank you all, I will submit the appeal today and also contact Instavolt directly. I'll let you know the outcome!0

So, received a response to my appeal today and this is what they have said. Please help with next steps?0 -
Also should have added, I also complained to Instavolt who didn't have a care in the world. All they asked is for the transaction details as they couldn't trace it on their system, so I'm assuming they wanted to make sure I had paid for the small amount of charging I did. Not helpful in the slightest!1

You surely expected that template rejection you are dealing with greedy unregulated scammers! They always say the signage is clear and plentiful whether it is or isn't, it usually isn't as below, that (if still the same) isn't good enough:As you have already been told the charging point where there should be signage has none pertaining to out of hours charging, in fact it quotes a 24hr helpline. I would take your evidence of this to POPLA:1
-
I'd appeal to POPLA, stating that this EV space is leased by Instavolt and has no contractual signs.
Show that bay image. NOT THE OTHER IMAGES. Nothing with the PPC signs.
Also attach any proof you might be able to gather, that Instavolt lease the bay.
Also attach the email exchange with Instavolt unless something they said damages your case. Why not ask them: please confirm that you lease this bay and when that lease started and ends?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is the InstaVolt response. It states that they do not own or manage the land and have no control over any parking restrictions. Very slopey shouldery from Instavolt!2 -
Yep.
But I say again this is winnable with evidence photos: there are NEVER any contractual parking t&cs signs adjacent to special bays
It's been a favourite trick for years for ANPR PPCs not to put any signs alongside bays where people are more distracted:
- parent & child bays
- accessible bays for disabled people
...and now EV bays are fair game.
They know the person will read the terms for charging. They clearly hope the driver won't look for more t&cs so they just never put a t&cs sign right there.
Clever scam. Only really clear when you start looking for signs & spot the pattern in retail parks. Entire disabled bay lanes unsigned but all other lanes do have a sign.
Classic sharp practice. Same in EV bay corners.
With photos to prove it, that's a winning appeal point along with saying Instavolt lease these bays in this corner and this isn't part of the managed car park enforcement boundary.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This will be their excuse which you'll have to argue about:
