Help required for Court letter for unpaid PCN

    Only say you were not the driver if true.

    That doesn't necessarily suggest you knew about the PCN; could just be you know it wasn't you because you hate that retail park(!), or that you know from your schedule that you were at work/elsewhere, etc.
    Should I remove 3.1 then?

    @Coupon-mad, please let me know your thoughts if I should be removing 3.1 paragraph

    My hubby has adviced to not add 3.1 as the POC details are not clear and the defence challenges that so he says it doesn't make sense adding 3.1 as it would contradict our own defence. Submitting it today.

    I have now submitted my defence and have received the automated response as well.i am little worried about the next steps and wantedto know if my husband can represent me in my case i.e. for the mediation and then the court hearing?
    He was the driver and would be the witness as well.

    You can nominate someone to take the mediation call on your behalf,  explained in announcements as to the 5 minutes no offer see them in court reply   ( or perhaps a cheeky offer of £10  ). Usually its thanks but no thanks,  easy peasy   ( no discussion of the case or who was driving   )

    He can be a witness if it ever gets to a hearing,  but you must be there as defendant,  conducting your own case, he cannot represent you. There is no legal compulsory reason to name the driver,  so don't,  just say it was a family member,  if necessary 

    Many cases are discontinued before the court fee has to be paid, so dont assume that a hearing in court is inevitable,  because its not

    He cannot be a witness AND lay rep.

    I sent my defence advised to ClaimResponses.CNBC@justice.gov.uk on the 5th of April and I received an auto =reply as well. But I have today received and Judgment saying that I haven't replied to the claim. What do I do? am I in trouble? I am really nervous now. Please please advise.

    Just spoke to CNBC and they said the district magistrate had reviewed the defence which was missed originally and judgment has been set aside and so to ignore this letter. They have sent a letter out yesterday and this was sent out incorrectly. What a relief! I almost had a heart attack, thinking now I will have to worry about this for this long weekend trying to figure out how to get this corrected. :)
    BTW if it actually needed top be corrected, was there a timeline within which we needed to do that?
