Help required for Court letter for unpaid PCN

Hi, I have receieved in March 2025  a Court letter for payment of a PCN. It says to acknowledge in 14 days and defend in 28 days. It is for a PCN for my car which my husband was driving and he entered his car reg instead of mine to park. since it is a while ago.

Before I defend, how do I get all the correspondence aroudn this PCN as nothing has been shared with me and due to the time gap, I don't even remember the entire history.

, I dont rememember a lot but, but below is the structure of events.
1. I explained that my husband was driving the car and explained teh situation as to how he entered his car reg instead on mine.
2. they rejected the representation saying that it was a major fault a not a small error. If I remember it correctly, they told me that you havent provided the other drives details, so you are liable.
3. I replied explaining I provided his name and shared his address again, but they rejected it asking to appeal with teh independent appeals.
4. they also rejected it with a similar respoonse.
5. then they started chasing me frm debt collection ever 6 months or so and I told them the same thing that there was no loss of income as it was alreadt paid under a  different car reg. infact I remember my customer also had sent Euro Car park saying that it was his him how used the car park and paid under the wrong car number and asked to either pay him back ro adjust it to my PCN but they never responded to him.
6. I in fact also offered to pay they 2.50 just to get this closed off and on teh phone they said pay at least 20. 

I feel it is a matter of principal and I should defend myself against these scumbags. I woudl acknowledge this but how do I defend myself when they havent provided the entire history and the grounds they are taking this to court. Would it be just that I would say, I am ready to defend myself and please start teh case and that is when they would send me the case file. So what are my options? please advise

    What is the Issue Date on your Claim Form?

    On what date did you file an Acknowledgment of Service? Your MCOL Claim History will have the answer to that, assuming you've read the Second post of the NEWBIES thread and have done it. If not: do it now!

    Then tell us the two dates and show us the POC, just like you see shown by people like you in every exact same DCB Legal thread. Read a few. They're almost all the same.

    In most current defences v DCB Legal claims, paragraph 3 (within the 30 paragraph Template Defence) looks similar to the thread below by @shahib_02  ... just change the incident date:

    No need for more detail except if you had something important to add about the site, signs, circumstances, or the allegation.

    Hold on. This sounds like a keeper liability case where the PPC has refused to transfer liability.

    Show us the exact wording you used to transfer liability (obviously without showing us the exact name and address)

    Hi, thank you for your response and sharing the link. It made it so easy to simply go to that specific thing. There is so much of information that its mind boggling. I called the claim court today and they said I have 14 days from the 9th of March to acknowledge and then additional 14 days to put my defence. I did ask them what should I do as I don't have old correspondence as it is so old. They said ask DCB or mention it in your defence.  But I guess the thread that you shared highlights this point from different angle, so I will use it. Also, I have read and understood how to do the acknowledgement, so would do this tomorrow and then prepare the defence thereafter. You asked about POC, do you mean particulars of claim? I have attached the copy of the claim letter,  can you please review and see if there is anything of concern.

    I need to find all this but as far as I remember once I wrote it was my husband (with his name) who was the driver and then when they rejected the appeal saying you didn't provide the address, I said, wasn't that obvious that he lives with me and plus I said I had provided the reg that he actually used for parking , that also would have helped you get his address the way you got mine. I need to find all these letters. So will come back soon on this.

    You should have provided his name and address,  even if it was obvious to you, it's not to them  !  Full disclosure was required 

    The date in the POC is probably incorrect,  so use one of the recent cases where paragraph 2 states that you were not the driver,  plus the recent numbered paragraph 3 that rebuts the POC,  wrong date etc

    With a Claim Issue Date of 4th March, you have until Monday 24th March to file an Acknowledgment of Service('AOS') but there is nothing to be gained by delaying it. 
    To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an AOS in a timely manner, you have until 4pm on Monday 7th April 2025 to file a Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.
    Don't miss the deadline for filing an AOS, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

    Hi All, I was preparing my defence and I have just noticed that there is no PCN number mentioned on the POC, is that normal or am I looking at the wrong place?

    If the POC is in incorrect and no PCN reference is provided, I actually then literally just have to use the first 4 paras of teh defence and highlight that it doesnt even have a PCN number to ask to get it cancelled. Am I correct? @Coupon-mad

    I am sorry if I am unable to understand this, I was reading your advise on the defence and it says:

    "7. (Then put in para 4 of the template defence onwards here and re-number all paragraphs below this. Your defence will exceed 30 paragraphs)"

    Are you saying I should refernce each line and then repeat para 4 each time?

    Also, the thread that you referenced above states he wasnt teh driver and so was I, but since they havent provided the PCN number just the date, should I actually say that I wasnt the driver? wouldn't that acknowldge that I actually understand what pcn ithis is for. Or should I say date the on the contravention I wasn't the driver? but then that was like 4 years ago and how would I still remember? Please advise as I don't want to get caught out.  @coupan-mad
