    So would my brief stop to return an incorrect takeaway order constitute to briefly stopping? and how long would constitute a "brief stop".....

    "Following this, the Court agreed that the Defendant’s brief stop to drop off groceries did not constitute parking. The claim was dismissed, and the Court awarded costs in favour of the Defendant under CPR 27.14(2)(g) , citing the Claimant’s unreasonable conduct and failure to rectify the false statement in their witness statement.

    This case underscores a pivotal clarification – a brief stop does not equate to parking. It serves as a persuasive  precedent that distinguishes between momentarily stopping and actual parking, bringing much-needed clarity to private parking enforcement practices."

    Well dropping off groceries / dropping off a food order would appear to be pretty identical. 

    Perhaps 5 minutes would be the limit.

    Surely it takes as long as it takes!  I think I read somewhere that picking up a preordered takeaway/groceries is counted as loading. Returning a wrongly provided takeaway should fall in the same category, it having be preordered in the first place.

    Just checking back in and updating.

    I've had my mediation call which lasted a good 15 mins. The mediator was a court clerk.
    I was given a figure of £181 that the claimant VCS would accept as mediation down from £260.

    I suggested £35!!!

    Was informed that if VCS apply for a hearing depending on the court which will be Sheffield it is taking 6-9 months to get to a court hearing.

    Today I received another computer generated call from DBLegal which although I answered wanted me to press 1 and as  I was driving I hung up.

    So, that would be 3 calls from DCBLEGAL all computer generated......I wonder what they were offering this time.

    I'm having my day in court!!!!

    Good, you have been given no choice rally, due to the lack of any fair appeals service. Don't miss the WS and evidence stage which will be next, once you get a hearing date.

    It's important that the Government hears from people like you with unfair charges who are dealing with threats of scary court claims. That's when you win ... but most people don't know that these cases are a greedy scam and are winnable.

    The link shows the two vital points to concentrate on, IMHO:

    - banning 'fee' add-ons completely.

    - making sure a new SINGLE appeals service replaces POPLA and the IAS which are seen as not fully independent and involved in a 'race to the bottom'.

    I've started completing the consultation questionnaire but have saved it till later as it's quite lengthy.

    Ideally it would be good to have an idea of what to put to the questions and how best to respond to them

    I will hold off from fully completing until your response discussion is completed.

    There is a thread dedicated to the consultation and there has been some discussion on it, also @Coupon-mad writes she will be opening up the discussion about it this week-end.  As someone who has been through or is going through the process, you are ideally placed to respond as to exactly how you feel about the actions of the PPCs, debt recovery agents etc.

    Received a Notice of transfer of proceedings.

    "This claim has been transferred to the County Court at Sheffield for allocation. On receipt, the file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judges decision will be sent to you in a notice of allocation" 

    Does this mean that the Claimant has filed for a hearing????

    In my DQ I requested the case be heard not "on the papers" but at a court hearing!!!
