    Hi Forumites,

    just updating on my appeal .

    Received today a Notice of Allocation to the Small Claims Track (Hearing)

    So, the District Judge, Judge Hassall upon considering the papers has ordered that the claim be allocated to the Small Claims Track and referred the parties  to Part 27 of the Civil Procedure Rules and the Practice Direction of that Part of guidance on how the hearing will be conducted.

    So, a hearing date has been allocated for Oct 2025 subject to the Claimant paying a trial fee of £27 (28 calendar days prior to the hearing date) OR file a properly completed application(i.e one one which provides all the required information in the manner requested) for help with fees, or the claim will be struck out unless the court orders otherwise, and the claimant be liable to the costs which the defendant has incurred.

    Will the claimant normally just pay the trial fee or file a properly completed application? and what should I do in the meantime, just wait to see?

    The Directions I have been given are:-

    - deliver to the other party and to the court office copies of all documents, including all witness statements(including the parties themselves) on which that party intends to rely on at the hearing , no later than 14 days before the hearing.

    - bring the original documents to the court

    Can I use a video clip during the hearing to defend my case? and will I need to get permission from the court for using a video to support my case

    - one clip from an expert (barrister) and would this be classed as using a "report from an expert" ?

    - my own dashcam footage approaching the entrance to the car park and the ambiguous/cluttered signage (5 signs) 

    Lastly, the order has been made without a hearing and therefore the parties have the right to apply to have the order set aside, varied, or stopped - does this mean if the claimant/defendant decides to discontinue their claim/defence?

    What reason's would any party set aside?

    That's a standard ending to orders made without a hearing. Neither party will want the hearing order set aside. It's just template wording.

    Will the claimant normally just pay the trial fee?
    Yes because VCS carry on biting. Usually. DCB Legal like discontinuing but if the few hearings we see, they are mainly for VCS & Excel.

    Video clips must be shared on a durable medium and as part of the Exhibits section of your Witness Statement bundle,  plus you would have to take a suitable display device with you on the day, I would expect 

    So the legal firm would need a copy in your WS bundle,  as well as the court too, both parties need to be served at least 14 days before the hearing,  especially if they pay the trial fee

    Or I guess provide a transcript of one of the video clips.

    Would Dropbox be a recognised medium.

    I will write to the court in the next 7 days informing of them my wishes to use video footage and ask what software to use.

    Lastly, are DCBLEGAL working on a no win no fee basis and does anyone have an idea what costs VCS risk in losing this case?

    How much per hour must DCBLEGAL charge a PPC for legal representation and will VCS be present in a hearing or DCB representatives?

    Durable medium is probably dvd or USB stick, not Dropbox or YouTube links

    Laptop or iPad might be possible devices 

    DCBLegal wont be at the hearing,  VCS might be but unlikely,  more likely to be an advocate,  so their costs could be a couple of hundred pounds or more if vcs lose , added to whatever the vcs bill is , including claim fee,  hearing fee etc

    I doubt that you will find out the contract billing between VCS and DCB Legal,  not that it matters

    They send a jobbing legal rep for about £100 but you aren't liable for those costs if you lose, unless you act 'wholly unreasonably' such as failing to send in a WS as directed by the court, or not turning up in time for the hearing. You don't risk paying hundreds more.

      You can use the system to show the court photos and video .

      There is a guide that shows how to connect your laptop, mobile phone or other device to a screen to present evidence.

      The guidance includes tips on using video links, DVDs and extended desktops.

    The Clickshare buttons allow users to share 
    a direct replication of their laptop screen on 
    the Jury screen, witness screen and Judges 
    Screen. It is therefore essential that any 
    device wallpapers are appropriate for display 
    within the courtroom. The user can then use 
    their laptop to display any evidence. 
    Clickshare is compatible with devices 
    running Windows (any version XP or later, 
    except Windows 8 CE) and Mac OSX

    just found this

    Evidence Presentation System (EPS) is being rolled out to the County Court and Crown Courts to replace ClickShare for displaying evidence in courtrooms, offering both wired and wireless HDMI connections. This system allows users to present evidence from their laptops directly onto courtroom monitors.  

    Since PPC hearings are in the county court then according to the above should have the EPS system one would hope 

    I will need to check with Sheffield County Court on this
