Ok I have found the data request link! Vanquis done, next AGG.
Thank you0 -
Hi,
My fight is the same and yes as below -
DSAR with Vanquis via ICO website.
Complaint to Vanquis after 31 days if no response - then complaint via ICO after 2 weeks from then
DSAR with AGG via the ICO site
Complaint to AGG after 31 days, then complaint via ICO 2 weeks later.
In both cases you are looking to end up 8 weeks later after the official complaint at the Financial Ombudsman to raise a complaint with them - because that is when you will probably get the true information as to what happened and when.
They have to produce something - and not regurgitated, missing information.
If you get compensation then that's a bonus - you also have redress through the ICO
I am just reaching FO stage so I await with bated breath.
I looked at the decision database and I believe if more people took this route the likes of AGG would change their tune - as most people give up and wait the 6 years.
I can't allow it - a CCA agreement has terms and conditions written all over it - what they can do and what they can't - the Ombudsman can get them to amend or clear your credit file.1 -

As mine has not been defaulted, I am not sure what happens re the 6 years. It says the opened date is Oct 2018 which I think is when I would have opened the Vanquis card. As it is not defaulted will it just stay there rather than drop off?
They have told Experian that they purchased the account in 2021 - so would it drop off in 2027? I am so confused!

Just as an update - I have received a reply from AG Massey and my complaint has been passed to a complaint officer to deal with. This was on the 13th March but I didn't receive the og email so only just finding out.
No word yet from said complaint officer....wonder if that is because he is busy or just because he cba responding. Watch this space!0 -
Just an update from me - still nothing from AGG / AG Massey other than an email advising this has been passed to a complaints officer.
No response to my subject access requests from Vanquis & AGG.
Experian have responded to say they will provide the data but it doesn't include contact details etc as it is just their internal portal - but at least I have their attention now. They have also passed on my complaint about this issue to their complaints team so see what they say.

Any news from anyone?
My complaint to experian went nowhere - just the usual not our data response. I have responded again.
I will be following the complaints procedure with ICO and financial ombudsman. Anything else I could do?0 -
Just an update on my side - I have now received the Vanquis subject access request which shows the date that AGM purchased the debt is Sept 2021. I was still making payments to Vanquis for nearly two years after this time so that will be an interesting line of enquiry.
AGM have sent an update saying they have not yet completed their enquiries and hope to respond within the 8 weeks set out (another month left).
So basically from what I now know:
I fell into arrears with Vanquis in 2020
AGM purchased the debt from Vanquis in Sept 2021
No one informed me so I continued to make payments to Vanquis for another nearly two years - until summer 2023 - before realising something was weird as the online account was closed and I could no longer get a balance on the automated phone service. I checked my credit file and the account was marked as closed so I left it to see what happens next!
I never heard anything from anyone.
The notes on the Vanquis record say to inform me that the debt had been sold to AGM but there are no records of letters being sent so assume they meant to send me this message via psychic transmission?
AGM purchased the debt but then sat on it until late 2024 when they started posted missing payments on my credit files - which I have seen as checking my file now on a regular basis. AGM still have not contacted me.
I have contacted them with a written complaint. They are making enquiries into this. What will be the outcome of these enquiries - who knows.
They haven't acknowledged my subject access request so I will be following that up separately.
Experian are as useful as a chocolate fireguard and will not do anything to assist as AGM respond to them so I must be lying/wrong/whatever.
Also annoyingly - Vanquis never defaulted the debt so I can't just wait for it to drop off? I am stuck with this now and am forced to resolve it with AGM which feels very aggravating that I have to chase someone to pay them money. FML.

Think you need to check these dates and edit your post so we can understand the chronology. If you've have not made a mistake, you've made nothing1

Vanquis must have defaulted the debt before selling it on, and that default date is the one everyone should be using.
You did a SAR on them. Is there no mention of it?1 -

They didn't default it and there is a note in the SAR to say the debt was not defaulted when sold to AGM.
It is not showing as defaulted by AGG either - they are just recording missed payments but I can't see a default date listed?
