    Regarding the ccj my brother received (I've sent a screenshot of his credit check in a previous post), is there anything he should do now and will anything happen to him? Or do we just wait until we get the outcome of my defence?

    Just to say you haven't 'defended' yet.  You're setting aside a CCJ, by way of an Application.

    If your brother wants his credit record separated from yours, he needs to contact the credit ref agency and show evidence to correct it.  Or he waits to see how yours gets sorted.

    I have recieved a response. Please see below:

    Thank you for your correspondence.

     

    Your tracking number KL615271235GB shows that your letter was delivered to a court in London on 27 September 2024. We have no record of receiving it at CNBC. Please provide more details about the address that you sent your letter to. The address for CNBC, where you should have sent your response to the claim, was clearly written in the response pack and it was your responsibility to return it to the correct address. As you don’t seem to have done this, and we have no record of receiving a defence, the claimant was able to enter judgment against you by default, without the need for a hearing.

    The CNBC are actually saying they didn't receive it,  they didn't mention anything about signing for it,  that is just an assumption by you,  because somebody called Caroline signed for it at a location in London 

    They are saying that the tracking number shows that it went to a court in London  (via London Camden Delivery Office  )

    The CNBC is not a court and is actually in Northampton,  not London ( it's a civil service building  )
    Address is,  St. Katharine's House, 21-27 St. Katharine's Street, Northampton NN1 2LH

    Check your paperwork on page 1 & 2, their address in Northampton is clearly showing , its 66 miles away from Camden 

    Effectively, they are stating that the wrong address was used,  (  an address in Camden,  London   )  or you provided an incorrect tracking reference.  The ECP head office is nearby,  30 Dorset Sq, London NW1 6QJ so probably went there for some unknown reason   ?

    This is why correct email addresses should be used,  not post,  email is easier,  quicker and cheaper

    Where did you send it? Why use post?

    I assume this was your application, WS and evidence of moving ... if so you'll have to send it all again but by email.

    I have already explained earlier why I posted it instead of using the correct form, I now understand that i should email from now on.

    In that case escalate the complaint with the CNBC (or the complaints email for HMCTS might be better) because your proof shows the defence went to DCB at Direct House and the CNBC at St. Katharine's House, 21-27 St. Katharine's Street, Northampton NN1 2LH.

    The tracking number on their response was the middle one,  not the bottom one,  so they used the wrong tracking number if you gave them a copy of the complete receipt   ?  Or you gave them the incorrect tracking number,  it's one or the other,  either way the details in their response were not correct 

    The tracking number for the CNBC in Northampton was actually   KL615271244GB
