Dcbl ccj - parking fine

Hi All,

I need some advice on how to go about the ccj I received. I have attached the letters I recieved from dcbl and the county court. I also attached my defence which I sent to all 3 parties involved to which they ignored as I've sent it tracked signed for.

I believe this is unfair and I'm not sure these letters are real or just scare mongering tactics.

Would be really grateful on some advice and guidance on this.

    Can you please show us your MCOL Claim History.
    That will help us understand what went wrong.

    It looks like a Judgment was made on 14th October 2024 - over a month ago. 

    Do not rush into paying anything. Paying won't remove the judgment.

    Doesn't look like you didn't file an AOS on MCOL, nor did you file a defence to the CNBC either 

    Meaning, you failed to follow the correct procedures on MCOL and didn't follow the correct procedures explained in the N1SDT claim pack

    I was advised at the time to send a letter to all parties instead. I understand I didn't follow the procedure of filing an AOS or CNBC, does this go against me even though a sent a response to them withing the time frame (25th September 2024)?

    If so, how shall I go about challenging this?

    Its already gone against you due to not following the justice process, that is why you now have a CCJ recorded against you 

    You cannot really challenge this, that should have been done over a month ago, almost 2 months ago, but correctly

    I understand, I was going through a lot of stress and depression during this time and have been seeking therapy which was why I wasn't on top of it.

    On the MCOL, it still shows the option of applying to set aside. Will I be able to try challenge it through this?

    It may do, but you should be checking their gov website for details, its definitely not a challenge, its a set aside in order to turn the clock back, just that phrase, SET ASIDE 

    IMHO you would have to pay them and upfront fee for doing so, of £303 , with no guarantee of success 

    Perhaps your health may be a factor. ? Check if they allow on medical grounds. ?

    Maybe you get help with fees. ) only you know , we don't 

    You stated that you copied in the CNBC when you emailed everyone,  ( or was it 3. Letters. ?  ) presumably they did not reply, so which email address did you use, and on what exact date. . ?  If by letter, did the CNBC sign for it. ?

    Yes I sent 3 separate letters to all three parties which they signed for. See below of the letter and signature proof to CNBC within the deadline

    It is not really a defence so I'm not sure it will get very far.  It's not even signed under a statement of truth. Why did you post a letter? Who advised you to do that?

    It will now possibly cost you £119 to apply without a hearing to prove you defended in time and the letter was signed for by all three parties (name who you sent the 'Defence' to). Oh dear.

    Alternatively, complain to the CNBC by email URGENTLY this week and prove you sent a defence. Refuse to complete an application or pay a fee and just keep complaining and 
    ask the CNBC to set aside this CCJ without a N244.
