Dcbl ccj - parking fine

  • Yes I sent 3 separate letters to all three parties which they signed for. See below of the letter and signature proof to CNBC within the deadline 
    Which 3 parties?

    It is not really a defence so I'm not sure it will get very far.  It's not even signed under a statement of truth. Why did you post a letter? Who advised you to do that?

    It will now possibly cost you £119 to apply without a hearing to prove you defended in time and the letter was signed for by all three parties (name who you sent the 'Defence' to). Oh dear.

    Alternatively, complain to the CNBC by email URGENTLY this week and prove you sent a defence. Refuse to complete an application or pay a fee and just keep complaining and ask the CNBC to set aside this CCJ without a N244.
    The 3 parties are:

    1. Euro car parks limited 
    2. Dcb legal ltd
    3. Civil national business centre

    I was not sure at the time on what to do as I was going through a lot of stress and a friend suggested and helped me send the letters directly to the 3 parties as my defence. I now understand that was not the correct procedure.

    So to confirm, am I clicking the set aside option and explaining my defence and showing them I responded to them in time, and for them to remove my ccj?

    Or am I doing this via email only as you have to a pay a fee to apply to set aside? Is this correct?

    Also, a few more things im worried about:

    1. Will baliffs come to where I live?

    2. Will the fee keep increasing or is capped at £278.84? (Dcbl is stating its £301.72?)

    3. My brother who has the same first and last name as me has moved out of house 7 years ago and has recieved the same dcbl letter. I believe his credit card is still registered at our house. If so, is this the reason a letter was sent to him and will the ccj affect him? Im not sure if we're both affected or one of us?

    I need some advice on how to go about the ccj I received. I have attached the letters I recieved from dcbl and the county court. I also attached my defence which I sent to all 3 parties involved to which they ignored as I've sent it tracked signed for.

    I believe this is unfair and I'm not sure these letters are real or just scare mongering tactics.

    Would be really grateful on some advice and guidance on this.

    So to confirm, am I clicking the set aside option and explaining my defence and showing them I responded to them in time, and for them to remove my ccj?

    Or am I doing this via email only as you have to a pay a fee to apply to set aside? Is this correct?

    You are COMPLAINING TOMORROW BY EMAIL TO THE CNBC and proving you posted a defence which was signed for and also by ECP and DCB Legal who should never have requested judgment. Proof attached.

    Also attach another copy of the defence RE-SIGNED again and dated, under a Statement of Truth tacked underneath ... to hopefully get it accepted as a defence.  Don't ask. Just add the missing SoT under where you signed it before.

    No bailiff will come to your home because it's under £600. They don't bother with cases unless they are over £600 where their own HCEOs can get a writ.

    Nothing will increase. You won't be paying and as long as the CNBC accept they and the Claimant received a written defence, the case should be put back and thd CCJ removed, and marked as 'defended'.

    £301 includes the judgment fee added but DCB had no excuse to request judgment in a case that was defended!

    They sent your brother a letter too because DCB Ltd did an address trace and think he's the same person.

    Can't change this but:

    I really wish you and your brother didn't have the same name because yes, it could potentially affect him too.  Wrongly. Temporarily.

    I really really wish your friend hadn't mucked this up for you. All they had to do was read the claim form or preferably come here first.  This is a headache to unpick.

    I found a template of SOT in one of the threads: 

    I believe that the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.

    Is this SOT ok to use? If so, does the SOT have to be in both the updated defence attached and email? I've drafted the email, please let me know if this ok to send.

    That SoT is only valid for a Witness Statement, not a Defence, the clue is in the name, Witness 

    I assume that you should get the defence SoT, the defence template contains it

    Don't finish a business communication with "Regards" the proper formal closing is "yours faithfully"
