    No, it's on file, don't jeopardise your case  ? ,  stick to the facts , the driver was driving the vehicle in and out

    KeithP meant that parking companies monitor vehicles,  using pictures 

    The pictures were of a vehicle entering and leaving, not a person  !

    To say "me" is incorrect,  to say " my vehicle " would be correct  ( words are important in legal situations , so no slang or similar terminology  ) , it may seem pedantic, but this is not your local pub environment

  • Thanks coupon. I'm  just confused how they expect to get away with it. They have 2 photos for each occasion of me leaving and entering the 'private road', but no cctv of me parking etc. There's no bollard or big signs. How do they get away with it.

    I've not read back through the thread, but do they already know who was driving?

    If not, then both occurrences of the word 'me' in that third sentence of your post would be better replaced with 'the vehicle'.

    Thanks Keith, in my MCOL defence I stated that I was driving with my friend and his son and that I had a blue badge with me.

    I am going to start preparing my WS this evening. 

    I am going to base it on lack of clear signage,. Nonproof of land ownership and that i was always stationary and never got out of the car and parked as the ecidence supplied to me only shows me.ebterong and leaving the carpark on 3 occasions. One of the 3 occasions was in the dark and there was also lack of lighting around the signage.

    How does this sound? Are there any WS I can use? I shared s successful POPLA appeal above which was identical to my claim, I.e same claimant, legal rep and location

    I wouldn't be using the term ME , you are the Defendant but the case is about the vehicle and it's movements etc

    The driver,  the Defendant,  or, the vehicle,  as mentioned previously , are suitable 

    Use the word STOPPED, not stationary,  STOPPING for a task is not PARKED. 

    There are numerous witness statements on here in other case threads, but there may be none that fit your case,  or exactly fit it

    You must start with the recommended ones and search for others,  especially completed cases over the last few years.  Use the Queen title of their hit song to find completed cases,  the title initials are A O B T D

    If there is nothing relevant,  then you must adapt one or write your own, same as all the others did in the previous cases

    You have to base it on what you put in your defence; your WS backs up and supports, with evidence, your defence.  You cannot add new defence points.  Recent WSs are @Harry77@imulsion and @Defendant911
