Today, 1st October, was our second preliminary hearing.
Representative from DCB Legal approached us beforehand, but we politely declined to speak with him.
At the start of the hearing, the judge questioned why not all PCNs were included in the case. He noted that at the previous hearing, we had agreed to settle the matter for £300 for all PCNs, but DCB Legal had refused the offer. He then asked the DCB Legal representative to contact their office to see if they would now accept the £300 to settle all PCNs. but he took too long as he could not get in touch with dcbl. judge then asked him to comeback in.
In the meantime, I mentioned to the judge that we had email correspondence showing that DCB Legal had already refused the £300 offer for all PCNs.
also said to the judge that DCB Legal have issued a tomlin order for us to sign, he seemed quite annoyed and said only court can issue a tomlin order.
When the representative returned, he said that he/dcbl wanted to proceed to a full trial.
At that point, the judge made it clear that he did not find their signage or terms and conditions to be sufficient. He said he did not believe DCB Legal had a strong case or a realistic chance of winning. As a result, he dismissed the case.
DCBL representative attempted to appeal, but the judge refused his appeal there and then.
Again, this was for this case, 4 PCNs, but i doubt that DCB Legal would take us to court for the other 3 PCNs as we can refer to this case and also judge's reasoning to fight the case. could we?
is this the end of this case? could they appeal again?

Be aware though that the other 3 PCNs can and will be pursued separately. They haven't gone away and this case isn't a precedent.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Persuasive though. In any future defence you'd be quoting what happened the first time round. And if they drew the same judge they'd be in for a rocky old time.4
