    going to get started on WS and evidence/defence.

    also had an email from dcbl asking us to call them and discuss settling the case, im going to call them tuesday next week after bank holiday

    from dcbl,  "Our client is prepared to make an offer to potentially conclude this matter. We ask that you call us on 0203 838 7038  to discuss this further."

    going to offer them £10

    No, this is a  preliminary hearing. Half an hour only. You haven't been directed to file & serve anything as Soton court knows DCB Legal will now discontinue.

    Canny judges do this to weed out parking claims. The judge knows that DCB Legal won't want to send anyone to a prelim hearing for 30 minutes! 

    Also had an email from dcbl asking us to call them and discuss settling the case, I'm going to call them Tuesday next week after bank holiday

    ok thank you, good to hear, so for now we don't have to do anything, don't call dcbl, just leave it and it will get discontinued.

    Almost certainly ... and if not, go to the prelim hearing and we can talk about what to say to try to get the claim struck out there and then. Soton judges will never allow the added £70 for a start!

    When you get the NoD, please show it here (not the DCB Legal email, the attachment) so that Umkomaas can count it!

    had a call from dcbl saying they will settle for £400 which we refused then a few days later had an email from dcbl saying

    Please find attached our Client's Witness Statement for the hearing.
    We confirm it has been filed with the Court.

    there is a long file attached around 70 pages, which i guess its normal.

    its a witness statement 

    when on log into mcol its does not show as being submitted to the court, yet.

    could you please advice on how proceed?

    MCOL isn't updated at this stage.

    WS and evidence stage are in the NEWBIES thread and loads of recent threads have example WS on them.

    Southampton judges will NOT allow the added £70 per PCN for starters.

    no idea what to do now.

    i was thinking to contact those debt collectors and inform them that pictures are unclear and blue badge was displayed in hope that they drop their case, is this a good idea? 
    They won't drop a 7 PCN case. There will be a hearing. You'll need a WS including stuff about the Equality Act 2010 and about the tenant's rights and easements from your brother's AST (or flat lease if he owns it).

    Show us their evidence pics of the signs. Close up and distance pics please.

    And the landowner authority document.

    And pages from your brother's lease if there is a right to use the common outdoor roadway for vehicular access. And any pages about a right to peaceful enjoyment'. And any pages about third parties.

    If the named Defendant will struggle with a decent WS and at a hearing, the Defendant (that's not you?) should urgently contact David at this company, to see if he can write the Defendant's WS and appear with the Defendant at the hearing:

    Affordable expert who we know well & trust. Unusually, due to this being a four figure claim, it might worth him (David, if he's free) going to Southampton for the 30 minute preliminary hearing - HAS TO BE WITH THE DEFENDANT - to try to get the claim struck out. David knows his stuff but needs contacting quickly and by the DEFENDANT.

    Decide immediately because although that Order doesn't ask for a WS from you, if he can help, David may want to put one in this week and/or a skeleton argument re the Equality Act (and primacy of contract covering your brother's carer who was concerned for his safety that week).
