    update:

had a call from dcbl saying they will settle for £400 which we refused then a few days later had an email from dcbl saying

    ------------

    We act for the Claimant.
Please find attached our Client's Witness Statement for the hearing.
We confirm it has been filed with the Court.

    ------------

there is a long file attached around 70 pages, which i guess its normal.

    its a witness statement

when on log into mcol its does not show as being submitted to the court, yet.

could you please advice on how proceed?

What happened at the preliminary hearing?

    It was last week.

What happened at the preliminary hearing?

    It was last week.
so, we went to the hearing, prepared a WS, and presented it, dbcl had someone present there as well.

judge said there will be a proper hearing, in the meantime dcbl person offered us £300 to settle, and i said no and again after a lot of back and forth, my dad as hes old and has had enough said he will be happy to pay that in instalments, like £20 a month, dcbl person agreed.

this was all happening outside the room btw.

as i was talking to dcbl guy, i said i need to be reassured that the whole case is settled, (not sure if this was a good or bad decision by me, but i need the whole thing to go away and i dont want them to start another court procedure for the other PCNs)  i.e. 7 PCN are settled for £300 instead of the 4 in this case.

he said that he can not make such assurances and this was only for the 4 PCNs, and if they (UK Parking, DCBL, ZZPS, QDR solicitors etc) decided to persue the other 3 PCN they might do that in future.

so i said i wont be happy to settle for £300 and then hope that they wont take further action for other PCNs.

we went back in and mentioned this to the judge, judge said this does not make sense, and she couldnt think of a reason why dcbl has brought only 4 of the PCNs to court, and said that the whole thing needs to be addressed and settled.

judge said to dcbl guy to inform his client about this and said there will be another preliminary hearing at a later date when all of PCNs are addressed, i think she said in about 4 weeks time, but not too sure now

so for now we are waiting for letters/emails from the court or dcbl/uk parking.

update. we have/had a hearing on 28th august, had this email. what could this mean?

    this was from the court

    "Good afternoon,

The above case is listed for hearing on Thursday 28th August 2025.

I do need to put you on notice that we do not currently have a Judge to hear this case and there is a high possibility this matter will have to be removed from the list, we will continue to try and secure a Judge but as the hearing is soon approaching this is looking less likely that we will be able to do so. This case may be vacated at short notice (the day before) if we are unable to accommodate the matter.

If you do not receive any further email from the court your case shall remain listed.

    Kind regards,

    Listing Officer "

It means what it says: the preliminary hearing (that you say 'the judge said to dcbl guy to inform his client about this and said there will be another preliminary hearing at a later date when all of PCNs are addressed') may not happen next week.

The Claimants won't like that as they won't know whether to pay a legal rep or not!

They have also NOT provided any evidence about the other PCNs, nor have they applied for 'relief from sanctions' and permission to amend their claim to include those extra PCNs.

So they'll struggle. Expect desperate emails from DCB Legal on Tuesday with an offer to settle!

We would NOT tell the Defendant to settle but he needs you with him and MUST attend all hearings or it could go pear-shaped behind your backs, if a bad judge glances at the case file with no input from the Defendant. In any event you/he will have to phone the court the day before, to see if this preliminary 30 minute?) hearing is happening or not.

    DO NOT DO THIS AGAIN:

"this was all happening outside the room btw.as i was talking to dcbl guy"

DO NOT CHAT OUTSIDE BEFORE THE HEARING. IF THE REP ASKS, POLITELY SAY NO!

Do not be bullied. You need a judge to hear the case. No settlements.

Wait and see before you do the Public Consultation next weekend with real anger and evidence to show the government - have you seen this thread below?

Get ready to fit in to do the government's Public Consultation if you haven't done it yet.

Their proposals are wrong. We must stop them:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-8-weeks-from-11th-july-2025/p1

We need every poster to come back & complete this vital Consultation before the deadline!

We understand that you may need some pointers. It looks laborious, we get that. So to try to help, I've written some guidance on that thread.

Any questions on the Consultation please ask - on the dedicated thread - but I've covered up to question 20 already in that first post with the sort of evidence and points a victim consumer might wish to use for their individual response, if you agree with what we'll be saying from our experience.

Whilst your answers must of course be your own, there are vital points to safeguard motorists interests to make, that many people may not think of without our guidance because we see cases every day and we know the background.

However, people like you & the Defendant have lived & breathed the intimidation, greed and unfairness first hand so your voice is needed!

    OK. As expected.

Do the Public Consultation while you wait. It. closes next week and takes a while!

And reply to that email and cc in the local court - clearly reject (AND DO NOT ATTACH - REMOVE!) the draft Tomlin Order and remind both recipients that this hearing was ordered by the previous judge to be a preliminary hearing at which all of PCNs are addressed'. The Claimant's refusal to apply to amend their claim accordingly is noted.

Attach a list of any hearing 'unavailable dates' (or whole weeks) plotted for the rest of this year. Think carefully. All busy or family birthday dates, work commitments, hospital appointments, etc. for you and the Defendant.
