Last Friday I wrote on your thread...

To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Is that not clear?

I think I already posted this on this very thread perhaps, but here it is again:

There's a template defence where you only write one paragraph. And it doesn't even matter what you put because DCB Legal will discontinue before the hearing, regardless.

Honestly, this is easy.  Easier than appeal.

Just add brief info about the circumstances but also deny the allegations. As seen in every thread like this. We win 99% of the time!

I hate providing links to threads because it stops people seeing how to hop around and finding & reading threads for themselves. But in the spirit of the Season, here's one showing what to put for para 3, but please look around and read more (saves us from having to reply with the same stuff on thread after thread):

That shows you some 'deny the POC' wording to include in your para 3. Just add a line about the circumstances & facts that you know.

And of course use the whole Template Defence but we don't want to be shown it ... please!

Then follow the first 12 steps in the Template Defence thread so that you don't need to ask about the DQ questions or the laughable Mediation phone call.

We hope that we are only needed again by Defendants at WS & evidence stage next year. The 'first 12 steps' advice saves us all time.

update, thanks for all the help so far. we have now received their DQ and DCBL letters inviting us to call within 7 days to discuss a settlement.

so now waiting for our DQ form to arrive to fill out as instructed in newbie thread.

what are the chances of them actually going to court?

That may well proceed to a hearing.

    No biggie!

Who will take his mediation phone call, you on his behalf? Mediators can be misleading about the 'costs risk' (they are plain wrong) and even bullying in some cases.

DO NOT LET A WEAKER PERSON TAKE THE CALL IF YOU CAN DO IT.

"tried to file appeal to UKPC their website says they have sold the debt so we can not appeal"

Quote this in your witness statement. They have relinquished the debt, so if they refuse to discuss it they cannot expect to attempt to claim it down the line.

i will be taking the call on his behalf, i intend to stand firm and do not agree to anything, as i think he has a strong case.

But have you read the three threads where DCB settled for a tenner (twice) and £20 this week? Worth a chat with him about a silly offer (NOT over fifty quid in my view).

Here are two of them, easy to find:

£20 or so sounds good tbh, don't mind paying them a bit of money to save some time and hassle. talked to a friend and they paid £25 two years ago to make them go away, but that was for one parking ticket, i don't know if 4 tickets makes a difference in their settlement figure. they also said they talked to DCBL directly before the mediation call and closed the case for £25

just to clarify and confirm, I will send of DQ and in the meantime ignore calls from DCBL and wait for the actual mediation call and then refuse everything stating that i want to go to court

    thanks

    No.

Not if you want to make a small offer!

    so to update....

We have a mediation call date in march, i will be taking the call on behalf of my dad and tell them i want the case to go to court

Also called dcblegal, they offered £700 to settle and i told them £25, they said "their client" would not accept and we will go to court

fun times, stressful, how much worse can this get? even if we went to court and lost the case, would they add a lot of fees to it? could they inflate it to like £1500 or something?
