How do they get ccj's though, by not responding to LoCs?Coupon-mad said:That opens the floodgates in their favour
The counter is though that it goes to court and gets thrown out which destroys their threat modellingNeither of that happens. Your case isn't going to set any precedent.
Sadly you are just a number to them. They are copying the DCB Legal MO and are almost certain to discontinue.they're likely nailing the money from the threats which I'd guess 75% payYep or people get default CCJs.0 -
Not responding to claim forms, often deliberately sent to old addresses. 80-90% of claims go undefended.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So no need for me to focus my WS on any of that then? Just the simple case law outlined within my defence.Coupon-mad said:But their WS will include all that, if they don't discontinue. I suspect the latter.I just want to make sure I have something substantial as a worst case scenario that it does make court lol0 -
Then study the example witness statements that are recommended by coupon mad, especially recently
Check the advice threads in announcements too, plus any recent cases at the WS stage, because a WS is not the same as the defence2 -
Hello, please let me know how this went! I am in a similar situation.0

What happened in the end? Moorside Legal discontinued or did you have a hearing?MrTottenham123 said:

Hi all, not to steal the ops post but since they havent replied and i was following the thread due to going through the same thing I thought I would update, my case was temporarily thrown out due to the POC but they were asked to send an updated POC and they did which resulted in a mediation then a court hearing date, witness statement submitted, rang the court and they paid the court fees but then a few days later they withdrew from the hearing4

So the court had requested for the claimants to resubmit their claim and pay a small court fee by 12th Nov otherwise the claim will be struck out in my favour. T minus 2 days and hoping nothing else is received from them or my local county court. They did welcome a counter claim from myself for the time I've spent on all of this also, have many people done that in the forum or not?
P.s another private PCN was received today (a final demand, despite no prior letters being received). Clumsy as I was watching my friends play a football match and didn't know my reg had to put into a tablet at the bar. So I am seeking confirmation of my attendance from the club house and hoping to get this waived off, otherwise I'll be back doing this whole process again.
This ones with One Parking Solutions so going to do some research on them now lol
All the best,
MrTottenham1232 -
Good to hear and gives me some more confidence now. Did you counter claim or left as is?Tilehilllocal said:Hi all, not to steal the ops post but since they havent replied and i was following the thread due to going through the same thing I thought I would update, my case was temporarily thrown out due to the POC but they were asked to send an updated POC and they did which resulted in a mediation then a court hearing date, witness statement submitted, rang the court and they paid the court fees but then a few days later they withdrew from the hearing2
