Hi All,
Looking for some advice on my case which I have provided a breakdown of below (I mucked up acknowledging the claim).
Long story short I was parked in an industrial area where a gym is located. I was with a friend who always parks opposite this gym where there are multiple other cars doing the same. Without checking I parked here to then receive a PCN a few weeks later. Looks like they have private parking signs up and a ‘yellow box junction’ type painting on the floor. Assuming this was designed to stop people parking and blocking the warehouses during the day and hours of operation. This was late at night (9pm ish) and all warehouses there was closed and locked up. The fine was £70 within 14 days & £100 thereafter.
Unfortunately at the time of the incident I had lost my job and therefore was not staying at my home address. I was staying with friends/family and working doing odd jobs to keep me ticking over. Upon return I noticed these unopened parking fines which they were pursuing.
I then ignored the next couple of letters received as I thought they’d leave me alone after a year of chasing. Since then, the debt has been passed to atleast 3 different debt collectors chasing for the money.

This then started to bother me so I responded to the claim (wish I knew about this thread first). I stated about my circumstances with losing my job and they actually accepted this and advise I could pay the original fine of £100.
I then disputed this further as they’ve accepted that I wasn’t at my home address whilst I lost my job, surely I should then be given the 14 day period again to pay the £70? With my response I stood firm and said this is unfair and I am only willing to pay the £70 and advised that if they continue to chase me via email and letters then I would submit a claim for harassment and my time spent (not sure if I can or not?).
I didn’t hear anything for months and months to now received this letter from Moorside Legal (another new debt collector on my claim) who are wanting to charge me £307.55?!

Harassment claim wouldn't have any legs, firms are allowed to chase up alleged debts by the usual means, mainly letters, letters from companies rarely meet the high bar to prove harassment
You have a debt collector letter, so please read post 4 in the newbies sticky thread in announcements
Come back to this thread if or when you receive a formal LoC giving you 30 days notice, plus includes financial forms
Also come back to this thread if you receive a court claim
Ensure that the DPO at the parking company has a suitable address for the service of papers, especially if you have moved in the meantime, because you don't want the hassle of a court claim going to an old address2 -
Stop calling this a "fine" it's a speculative invoice, it isn't even a debt unless proven in court. In the paperwork they use the word debt as they are claiming you owe it, you won't find the word "fine" on any paperwork or signage as it isn't.In conjunction with the advice above study the newbies thread it's all there, pity you didn't find this site sooner by offering to pay something you are now marked as low hanging fruit.2

Yes. Ignore them. Search the forum for where we laughed at Moorside Legal last year.
There is no 'claim'. It isn't at court stage and you need to ignore them EXCEPT to tell them to erase that old address so it is not used.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

........... and it should go without saying (but I'll say it anyway) keep your V5C up-to-date when you settle at a permanent address or choose somewhere that you can access easily to collect mail; you don't want a N1 court claim going to somewhere where you cannot access it!2

Hi all, thank you for the advice. I will revert back to the newbies post and try and get my head wrapped around it all.
I’m still at the current/same address now it was just whilst I was working away (trying to do any jobs I could find) & staying with friends whilst jobless but that only lasted a few months now I’m back residing with my parents at my main address.
I’ll look to continue and ignore these mob then & await to see if I do receive anything further like a LoC etc.

Hi @Coupon-mad please note that I have now received a letter of claim from Moorside Legal and a little unsure on the next steps. I’ve had a read through the beginners guide and tried to work out the next steps, but I’m getting myself a little confused as this is all new to me lol. I have attached a copy of the letter and just wondering what to do from here?
Do I now respond to the letter with the draft/templated response within that beginners guide or am I getting this wrong?
