Will they win? Highly unlikely.
Any risk defending? No. No CCJ risked by doing exactly as we advise. Carry on as advised.Hi all, just received Moorside Legal’s response to the templated email from the newbies thread. What do we think? As they are the new kids on the block and not sure how many others have got this far with them.
What would be the next steps from here? Just ignore them again and hope they leave me alone, or do we think now that I’ve responded to them they’ll look to issue a formal letter of claim? Thanks all!0 -
Tell them they haven't answered the question about VAT on the 'debt recovery fee' and you require an explanation of who keeps the added £70 extortionate add-on and does that £70 already in include the VAT that applies to fees?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just because a code of practice says it is recoverable does not mean it will be allowed in court!A code of practice is a voluntary code used in an unregulated industry.3

Thanks both for your responses, I have replied accordingly. From looking at the forum it looks like I’m in the deepest with Moorside Legal so I shall keep posting updates within this thread when they come, so that others that get the same from them can follow. If that’s all okay? Have a great weekend! I’ll see you for when they finally respond again.0

I’m contemplating how to respond to my LOC from Moorside for £170. My PCN was from last year. I might try a different approach and update you on the outcome. I had chosen to ignore until now because of the CCJ threat.0

What is your different approach0

Hello, MrTottenham123 and all
I got the same Letter of Claim from Moorside Legal, PCM sent me a parking charge to my old address and when i got the letter, it went to the hand of Debit collector. I talked back to PCM and they said they can't help and no response afterwards. This incident happened 2 years ago and i thought it was gone. Last week, i got this letter and was shocked and felt stressed, Even in this letter of Claim, my address is wrong. Luckily neighbour passed the letter to me so that i can notice.
I saw this threads and would like to follow your footprint.
May i know did you modify the template and add any reason (above the 2 questions) in the template?
Wish your defense successful!0 -

Wish your defense successful! In regard to post from the PPC/solicitors going to the wrong address, you need to send both of them a rectification notice, telling them to erase your former address and replace with your current one. Now you're at the business end of this, you cannot afford to have any post going to an old address.Have you updated your V5C (logbook) with the DVLA, as it's from your logbook details that parking firms acquire your address. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
