    I got a reply from Toyota;


    After checking our records, we can tell you that we did pay a discretionary commission to the dealer. We'll treat your email as your complaint. We normally have eight weeks to send you a final response letter, but the pause introduced by the Financial Conduct Authority means the period starting on 11 January 2024 and ending on (and including) 25 September 2024 is not counted when calculating this eight-week period. 

    We'll be in touch with you after 25 September 2024.

    Suppose i need to wait til september now!

    Do note that if the FCA continues investigations, it may well be much later than 25/9/24 - due to the number of speculative complaints and a lot of other things, you might simply get a response then saying to wait until the FCA finishes. That is assuming the FCA don't simply decide as DCA was not banned at the time, there was no issue.

    I've just had the same response around these items.... even thought I have sent them a copy of the order form from the dealer & the agreement number.

    It looks like Toyota are trying to brush off any claims over 6 years old by making it impossible for the claimer.  Surely the responsibility resides with the finance company rather than the individual that was potentially misled when taking out the finance ?

    •   Registered keeper details (for example, the vehicle's logbook showing your name, or a DVLA letter).

    •   A copy of your driving licence.

    •   A copy of a utility bill in your name dated within the last three months.

    The FCA rules on this investigation do not allow them to "brush off" anything. If they have destroyed paperwork in line with GDPR regulations then they have a right to ask you to provide them as what you have provided doesn't show them enough. You are accusing them of wrongdoing (albeit in the large context of an ongoing investigation) so you have the responsibility to provide them with details if they don't have them. Their request seems quite reasonable to me to see if they can find your details.

    Discretionary Commission Enquiry

    After reviewing our records, we can tell you that no commission was paid to the dealer for your introduction. 

    As an FCA-regulated firm, we are bound by the consumer duty and a high level of integrity, the position as set out to you is complete and accurate.  As your account has not been impacted by a discretionary commission model, we therefore consider your enquiry and the matter closed.

    You are asking for proof of something they didn't do.

    You are entitled to ask for any information the company withhold about you under the data act and for me if the company has done their investigation they should provide you a copy with their findings.
