Still waiting for a response from Toyota, too. Has anyone had a response yet? I had a generic 'we're looking into it' email 5th March (my email was sent 6th Feb).
The FCA has suspended all complaints about DCA until after September to give it a chance to decide if there is any wrongdoing and what action should be taken by consumers.  Firms no longer have to deal with your complaint.  They can stack it in a pile awaiting the FCA decision.

  • Just had a reply from them .

After reviewing our records, we've not been able to find any record of your agreement with us. This may be because our data retention policy requires us to delete data after a certain amount of time has passed.

To allow us to make further enquiries with our records, we'll need you to send us all the following:
    • A copy of the agreement you had with us.
    • Registered keeper details (for example, the vehicle's logbook showing your name, or a DVLA letter).
    • A copy of your driving licence.
    • A copy of a utility bill in your name dated within the last three months.
All my cars have been through toyota. From 2014 onwards
I haven't got the first 2 on the list.

I've had the same reply even though I provided a copy of my finance agreement number. I am unsure to what be benefit most of those documents are going to be given I got married two years ago and my finance agreement ended in 2016.

Data protection rules generally mean deleting old data when no longer needed, it's typically 6 years for finance stuff - some firms archive stuff off in digital forms that need more information to find it hence the details.

If both of you no longer have any records and the dealers don't / can't find them then your complaint will probably be at an end

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • I had the same response off them. I gave my agreement number. I don't understand why they need driving licence utility bill etc

Either to help find you or to prove you are the person authorised to make the complaint

They are required to identify the complainent.   Even more so if you use a third party complaining system.

That's not why they're requesting it:

"In addition, please note that the information we have requested is required to be able to identify the commission models which were used around the time your agreement was taken out, not as a means of identifying you, as we have deleted your personal data from ours to comply with data protection laws."

@dunstonh post still stands. Be no pay out with knowing who they are corresponding with.
  • I emailed them 07.02.24.
got an ‘auto’ response on 05.03.24 to say they would reply within 28 days and then got an email today stating I did have discretionary commission on my agreement and they would be in touch after the pause ends.
