Why do you assume their late WS won't matter? Nothing has changed. It DOES matter. Some judges would consider striking their WS out.
Raise it as a preliminary matter at the start.

just back from court. 282.00 to pay in costs but he refused to award the interest as they hadn't bothered to break it down for ease. I stated my case but the facts were against me and i felt if he could have thrown it out he would have. He smiled when he said i recognise the witness statement and defence but at this time i cannot overturn it. Thanks for all your help but they won this time.2

Why is it £282 when the claim form says £255 ? Or is it a typo ? Because a typical loss is around £212 , not £2821

It was all there with detailed reasons.
You didn't have 'nothing'. You had loads to say. Judges want you to say it.
Going to a hearing means voicing your points from defence. Sounds like he gave you every chance to ask for the £70 to be removed, which is a shame because you had that written in your defence and only needed to say it.

He also said i had to pay in 28 days however the last time i was in court in a possession order the tenants owed me thousands and i have still not received a penny!! ???? I will pay in instalments.0
