Group thread: Heathrow Gatwick Manchester & other Airport drop-off PCNs - easy: how to appeal & win
Comments

The gullible tree is ripe with low-hanging fruit.1

Good afternoon,
I had a PCN because I went to pick up my brother at Gatwick north terminal. He was already outside the parking entrance so I stopped 15 seconds to say hi and let him in.payed the normal puck up charge at exit. However the the PCN says it is a red route and stopping not allowed etc.
My questions are the below.
Can I still appeal with the template posted here?
Will it be valid despite them having footage of me exiting the car and opening the boot?
Is the most updated template to paste the one on the first original post?
Many thanks for you support.

Yes to both your questions

Yes it works.
No need for lots of posts about it. No case is different. This group thread already explains.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok thanks for the support, sorry for asking redundant questions. I struggled figuring out even after reading the posts.
I' ll update with the result.
Many thanks2 -
Hi, can I appeal using the letter template if I'm leasing the vehicle that APOCA have issued an invoice for? I ask because my lease company is the registered keeper.0
-
Get the lease company to name you as the HIRER of the vehicle, then you appeal as hirer. POFA still doesn't apply so make sure the lease company knows not to pay the scam.tjpcrabfat said:Hi, can I appeal using the letter template if I'm leasing the vehicle that APOCA have issued an invoice for? Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'

HI, just to say thank you.Coupon-mad said:DO NOT PAY ANY OF THE PARKING COMPANIES ISSUING DROP-OFF PCNs.
Advice will change as & when the Government introduce the new statutory Code of Practice and new Appeals Service. And when the companies concerned finally learn (after statutory regulation forces them) how to treat consumers fairly and put up clear signs.
Current advice re Airport drop-off PCNs:A Where the appeal time limit has not expiredIf appealing online, do not click any boxes that indicate who the driver is. This appeal is normally accepted by APCOA (Heathrow and Manchester) and NCP (Gatwick) without the need for a further appeal to POPLA.
On receipt of a Heathrow, Gatwick or Manchester drop off PCN, appeal as follows, thanks to @ChirpyChicken
----------------------------------This is an appeal by the registered keeper - No driver details will be given. Please do not bother with your known fishing expedition in an attempt to get driver details to try and get around the fact there is no keeper liability (and never can be under POFA).
Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.
As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw
If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN
So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it).
----------------------------------B. Where the appeal time limit has expiredEmail a COMPLAINT (not an appeal) to APCOA/NCP saying exactly the same thing as in the standard keeper appeal
Regular poster @troublemaker22 says from his experience:
APCOA will normally back off but NCP will go into full "debt recovery" mode including instructing the buffoons at BW Legal to threaten, and in some cases launch, doomed legal proceedings that are easily defeated, especially if the refusal to identify the driver is maintained.
used the template on page 1 to appeal for pcn at Stansted airport drop off and it has been cancelled by apcoa.
thank you5 -
Course it was. 100% wins

I got a response from APCOA saying "We have carefully reviewed your appeal, taking into consideration all the points you have raised and, on this occasion, we have decided to cancel this Parking Charge."Umkomaas said:
Provided you have received a Notice to Hirer direct from the PPC (in your name and address) then yes. If it's simply the lease company forwarding a copy of what they've received from the PPC, asking you to 'deal with it', then that won't work. Formal transfer, followed by a personal NtH, is the essential step to getting that cancellation.wolfston1970 said:Apologies if this has been asked and answered before.. Does this appeal work when it's a lease car and the lease company passes liability to the individual lessee (not a business), referring to them as the 'nominated person'?
Thanks to everyone in this thread for the great guidance.5
