    Not that it matters. Two wrongs don't make a right and the OP won't pay a scam PCN on our watch!

    You follow the advice. Don't pay. Do nothing now, just ignore anything further from EPC, don't try the IAS, come back if you receive a formal Letter Of/Before Claim from EPS's solicitors (if they go that far) or a county court claim via the Northampton CNBC. We'll help you if any of the two latter stages occur. 

    Read the NEWBIES thread more to understand more. Everything is in there.

    Thank you for the suggestion. Actually, i'm not a uk citizen yet, so don't want to do anything which can affect my ILR. I was thinking for appealing to IAS, although i know, it'll be rejected as presumed. At least, i'll have a ground then. 
    But after that, i won't answer to them, until court letter.

    What do you think? As you're more experienced and this is kind of my 1st case, that's why, i'm little bit confused.

    Looking forward to your suggestions all!!

    Nothing to worry about, as this is what's called a Civil case/matter, and not criminal,

    Also private parking company's are not any form of an authority or any form of official body

    So you have nothing to worry about.


    For it to have an effect the following needs to happen, and even then it will be a civil and not criminal issue :

    1: they take you to court, these are civil and not criminal cases, they ( the parking company) say you owe them money, you say you dont, following the advice form the regulars on here can help avoid the thing getting to court and you should,as is your civic duty try everything you can to prevent a case going to court to be decided on , including putting maximum pressure on the landowner who is responsible for the actions of its agents 


    2: if it does go to court, then again you can get help with defending your case, you will need to work with the regulars on here and its usually possible to defeat the parking company's, as this is a civil (aka small claims) case its not as formal as a criminal case - however as its a civil small claims case then the "quality" of the judges can vary (DDJ lottery)  and things will need to be explained to the judge carefully


    3: Should you loose then you will have a time frame in which to pay up the amount that you will have to pay wont be huge ( others can verify this) as long as you have been reasonable - in fact being reasonable and showing that you have tried to resolve this can help you , however if you do loose you will have some time to make payment


    4: if you do not make a payment, or get the case set aside or appealed then you can get what is called a CCJ this will have the effect of giving you a poor credit score - a crediit score is something that most people have, its used by companys when you want to open a bank account, take out a loan, rental, mobile phone contract, mortgage ( loan for buying a house)  and so on  this poor credit score will remain for 6 years, and even then it may not affect anything  too much with regards to official ie state authoritiys

     A CCJ is a pain and will cause you issues with everyday essentials such as phones, housing, and certain jobs, and should be avoided, the big one that could have an effect on official things would be a bankruptcy but that shouldnt be be as a result of a private parking charge and is something all together different

    Thank you all for the response. But if i loose the court claim, then i have to pay the whole court fee + the fine, right? This forum is really awesomely helpful. 

    But i'd like to know, is court hearing like POPLA? or it completely different type? Can we present the whole evidence like people generally do in POPLA? 

    Anyway, i've gathered some evidence from the site, which should be good enough to put the operator into pressure. If it was POPLA, i must have appealed there, but i don't have any faith in IAS. For the last time, i'm going to send email to the DPO, sending all the evidence i gathered against PCN. Then if its not satisfactory, i'd ignore their mail. They have already provided contradictory information, so this time, they can't get away.

    We don't see many losses in court.  Most don't even make it as far as a hearing.  Very easy to defend.

  • Just today, they sent me another letter, saying i owe them 100 pound for the PCN.

     Its being posted on 08.02 & received on 10.02.
     I sent them email on 18.01, asking for evidence. They replied on 23.01, saying they refer it to their solicitors. Again, on 02.02, i emailed them about previous one and asked them to reply by 06.02, otherwise, it'll be deemed as being cancelled. I told them, this email will be taken as evidence if any court letter is issued.
    Now they send me this letter.
    What should i do, ignore it & wait for the court letter?
