if a company has no consumer credit agreement, only a scanned copy,can a court enforce it

YES , It does not have to be a true copy , but it must contain all prescribed terms . Many companies are sending copies of Application forms , which are not Agreements . If you are supplied copy of an Application form this is not enough for them to have the debt enforced by a court .0

Both my DCAs have now got their CCA letter.
Using the Post Office track'n'trace facility one DCA signed for the letter and the other didn't, but the latter did send me a letter acknowledging that they got my letter!
I'm now counting down the 12 days. I'm confused about the +2 days: when are they counted?Nerd Club - 754; Long Hauler - 55; DMP SC - 104; BSC 1210 -

From the date that the letters were recieved, or, as in the case of the dca that did NOT sign for it, you can reasonably assume that they recieved the letter no later than 2 working days after you posted it.I am NOT, nor do I profess to be, a Qualified Debt Adviser. i have been reading this with interest but am a little confused. i have debts with egg, barclays, barclaycard, MBNA and student loans co, all of which i am paying through a DMP with CCCS. none of them have been passed to DCA's.
am i right in thinking that i can ask for the CCA from all of the above and if they cant provide it i can have the debts written off? or does it have to have been passed to a DCA first?0 -
My second request resulted in me recieving a letter confirming the account had been sold to the DCA. two days later i recieved a copy of a APPLICATION form . They say i should now pay the account in full Before its sent to the enforcement dept. OH YES RIGHT ! I,LL DO THAT ! Its wait and see , they have still got 3 weeks to comply . I will ,nearer the deadline , inform them of the requirement to supply a true signed copy of the AGREEMENT.0

Also had a email from CCCS , confirming any action to enforce a debt using only a copy of an Application is easily defended !0
