    Quick question. I have an old settled MBNA credit account on my credit reference file. It looks nasty with lots of missed payments. The account was open in 1997 and settled in 2004.

    If MBNA don't supply me with the CCA can I ask them to remove the account from my credit reference file?

    I,m not saying that the debts are not there , just that they become unenforceable if the Agreements are not correct, or lost .

    The debt isn't there because it has been paid in full. Just wondering if I can get the entry on my credit file removed.

    If you took on debt ,and were given the correct imformation and both parties signed the correctly assigned agreement ,theres no question, you should do everything in your power to service the debt.
    The problems arise when you hit on hard times . The loan companies /card companies, will not listen to you , shove on loads of costs .They then default you , and sell your debt cheaply to DCA ! These DCA ,s will then do everything and anything they can to force you to pay amounts you can not afford . So I believe , I then have the right to use the CCA IN MY DEFENCE in any action taken by these DCA,s

    Sorry , These records show your history of past bad debts . Other companies will then decide if they want to risk lending money to you .
    There are template letters for full and final settlements

    Sorry stapely I'm not sure I made myself clear. The debts was paid three years ago, I don't owe MBNA a bean. I was just thinking laterally. If MBNA can't produce the CCA then the agreement never existed. If it didn't exist it shouldn't be recorded on my file.

    Does this make sense? Am I barking up the wrong tree?

    They stay on your file for 6 years, settled or not. I have settled accounts on my file from 2002
