I have had many letters from various companies chasing old debts. I am not denying that I owe this money or trying to get out of paying it, but in some cases the debt has been passed on so often it is not clear who they are acting for. One company Carrs was very insistent and rang every hour for weeks, I ignored the calls until one day my son answered and passed them over. I asked them for proof that I owed money as they had bought the debt from somebody else. On the phone they would not give me any information unless I confirmed my identity to them, they wanted DOB NI number. They didn't get them.
3 MONTHS later I received a letter with a photocopy of a credit agreement, signed by me in 1997, for a loan which I am certain I paid off in 2000. I wrote asking for proof that I owed money on this loan, and again they sent the CCA. I wrote again saying that this was proof I took out a loan, could they provide proof that there was money outstanding. Their response, that I should prove to them that I had paid the loan off. As its 2000 since you had contact it will be statue barred anyway . I would remind them of that.0

Update ! Well after the expiry of the 12 + 1 month . The DCA have written saying the are no longer dealing with the account . And I should now contact the OC. Well, as I understand the conditions of the CCAct ,as they were acting for the OC , they are still bound by the conditions of the ACT. The account is still therefore in dispute ,and only enforceable by a court order . I think its a ploy of the OC ,s to distract from the real result of the DCA,s non compliance, which is also there own non compliance .
What i expect to happen now it a demand from the OC for full payment , with no mention of there failure to supply a true signed copy of a AGREEMENT. Followed by a letter from another DCA . If this happens I will make a full report to the Office of Fair Trading .0 -
