    DO NOT SEND A CHEQUE THEY CAN COPY YOUR SIGNATURE ON TO A CCA :mad: :eek:
    SEND A £1 POSTAL ORDER ALONG WITH A TEMPLATE LETTER FROM CCCS OR NATIONAL DEBT LINE OR PM ROG2 OR WELLER THEY ARE THE EXPERTS ON HERE :D

    DONT FORGET TO SEND RECORDED DELIVERY TO PROVE RECIEPT

  • when I request my CCA do I send it to the DCA or the OC.

    Mine has been passed from natwest to a DCA in another country. I can't understand the letter because it's foreign and the debt is now in euros not GBP. Not sure what to do. I'm sill paying my arranged amount via my DMP into the natwest uk account.
    I've phoned natwest and they weren't helpful - telling me it was nothing to do with them, Ive phoned the foreign DCA(part of intum justitia) and they were very nice but also said nothing to do with them, I phoned UK intrum justita and they say nothing to do with them.
    All I want to know is who has the debt and who should I pay. Natwest say they have received my money but I don't know what has happened to it because the DCA say they haven't been paid for over 12 months hence the huge amount of interest now on top of the original debt.
    Any help appreciated

    ALWAYS send any request for a cca to the person that is 'pursuing' the alleged debt. It does not matter whether it is the Original Creditor or a DCA who is chasing the alleged debt, as they are legally obliged to provide you with a copy of the original cca, whether or not they are the original lender.

    I am a bit surprised that Natwest have passed the 'debt' on to a 'non-uk' based dca (unless it is Republic of Ireland) as that dca would have even less authority than the UK based 'vultures'. I would be more than interested to know if they could 'legally' convert 'debt' into other currencies. :confused:

    I moved from the UK a few years ago and gave them my new contact address. It' not northern ireland it's somewhere a bit warmer. I would say where it is but I get worried about giving out too much info on public forums. If this information is needed to get the best advice then let me know.

    No worries, nmnm - It's just worth your while knowing that UK County Court Judgements have limited, in most cases NO, validity outside of the UK. This is, equally, the same for dca's - whilst they may have 'reciprocal' trading agreements with their conterparts in other countries, these agreements count for nothing in the end, as all that a dca can do is to ask you if you wish to make any payments to your UK debt. They can not take legal action against a UK Consumer Debt through the courts in your current country.

  • Thanks again rog2, well the cca requests are waiting to be posted. It's a nightmare because I can't send a postal order from here and following all this advice I can't send them a cheque. I think a quick call to the UK to ask for some one to send the £1 payment for me is needed.
  • I am really worried that if I send these requests that the creditors will decide to issue a statutory demand and then follow it upwith a bankruptcy petetion. I've read that if they don't supply the cca then the debt is unenforceable - but what if they do have it and decide to take further action. Has this happened to anyone????
