  • Yes you can check your MCOL history to see when the court sends you the N180.

    Look again at that checklist you were following.
    This time read paragraphs 7, 8, 9 and 10 on that list.

    The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
    What you don't know is when the CCBC sent a copy of your Defence to the Claimant. 
    It follows from that that it is not known when the Claimant has to respond to the CCBC. 
    Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?
  • I have been looking at the Newbies page as to how to complete the N180 form. 

    I have also seen some threads with the updated form, however I am yet to see anybody update the form based on the new lettering (A1, E1 etc). 

    Looks like system was the last person who updated this in 2016. I am happy to create a new forum and update the answers based on system's initial answers, but I need reasons for saying "no" to Suitability for determination without a hearing.

    This is system answers from 2016....

    Filling out the form

    A1 = Say NO to mediation (they want the whole amount, you want to pay them nothing, so no scope for mediation. This will not go against you). Mediation is run by a commercial company on behalf of the courts and their success is measured by how many cases are kept out of court. They are not interested in the merits of the case, only whether you will pay or not. So say No.

    B = fill in all the details, your name, your address, etc. This is the address that all the paperwork will be sent to. If you are moving home within 6 months make sure you have mail redirection in place. You will get a default CCJ if the paperwork doesn't get to you as the Courts see it as your responsibility to give a correct address.

    C1 = YES to small claims track – this is the limited costs track for claims up to £10,000 in value

    D1 = name of your local County Court – unless you are a Limited company, the case files will be transferred there. They will ask for theirs but protocol dictates it is your court. For example, MIL Collections always asks for Truro and Devere Parking always ask for Bournemouth. You, literally, do not want to go there.

    D2 = NO to expert evidence (this relates to medical negligence cases and suchlike)

    D3 = 1 witness (that’s you) (or more if you are going to get another person to provide a statement)

    D4 = Put down the dates of any pre-booked holidays, NO to interpreter (unless you need one)

    You send a copy to the courts and another copy to the Claimant company. Keep a copy for yourself. As mentioned before, there is a long delay (20+ weeks) between this form and an actual day in court.

    Hello Experts, I got the DQ form in the post, which I've completed abd emailed to the same email address where I sent the acknowledgement of service to. I've also sent a copy to DCB Legal.

    I sent the DQ to the courts at 6pm on Wednesday and received an email acknowledgement but the MCOL hasn't updated.

    Do I email the form again or wait? I dont want to run out of time.

    MCOL will eventually update. If you've received the email acknowledgement then that's fine for now. Just keep checking as it is entered manually and they are swamped at the CCBC so could take a bit of time.

    Hello, I sent my defence on the 09th March 2023 and received the attached letter. I sent my defence to the court and copied in DCB Legal as advised on the newbies page.

    What are they talking about?
